Federal Court Rules (Amendment)

WE, Judges of the Federal Court of Australia, make the following Rules of Court under the Federal Court of Australia Act 1976.

1.   Commencement

1.1 These Rules commence on 1 August 1994.

2.   Amendment

2.1   The Federal Court Rules are amended as set out in these Rules.

3.   Order 13, rule 2 (General)

3.1   Subrule 2 (1):

Omit “The Court may,”, substitute “Subject to the following provisions of this rule, the Court may,”.

3.2   Subrule 2 (3):

Omit the rule, substitute:

“(3)

Where an application to the Court for leave to make the amendment mentioned in subrules (4), (5), (6) or (7) is made after any relevant period of limitation current at the date of commencement of the proceeding has expired, the Court may, nevertheless, grant such leave in the circumstances mentioned in that subrule if it thinks it is just to do so.”.

3.3   New subrules 2 (4), (5), (6) and (7):

Insert after subrule (3):

“(4)

Where there has been a mistake in the name or identity of a party, an amendment to correct the name of the party may be made notwithstanding that the effect of the amendment is to substitute another person as a party.

“(5)

Where an order to correct a mistake in the name of a party has the effect of substituting another person as a party, the proceeding shall be taken to have commenced with respect to that person on the day the proceeding commenced.

“(6)

An amendment to alter the capacity in which a party sues may be made if the new capacity is one which that party had at the date of the commencement of the proceeding or has since acquired.

“(7)

An amendment may be made notwithstanding that the effect of the amendment will be to add or substitute a new claim for relief or another foundation in law for a claim for relief if the new claim for relief or foundation in law for that claim arises out of the same facts or substantially the same facts as those already pleaded to support existing claims for relief by the party applying for leave to make the amendment.”.

4.   Order 71, rule 38 (Filing in Court of documents in support of an application under section 459P or 462)

4.1   Subparagraph 38 (1) (c) (ii):

Omit “paragraph 37 (4) (b).”, substitute “subsection 459E (3) of the Corporations Law.”.

5.   Order 71, rule 77B (Application to set aside disclaimer after it has taken effect—section 568E)

5.1   Subrule 77B (1):

After “Law”, insert “to”.

6.   Order 71, rule 98A (Leave to manage a corporation where a person is subject to a civil penalty disqualification—section 1317EF)

6.1   Subrule 98A (1):

After “person”, insert “who”.

7.   First Schedule

7.1   Form 93:

Omit “with Form 93B”, substitute “with Form 93A”.

7.2   Form 139:

Omit “with the District Registrar”, substitute “with the District Registry”.

7.3   Form 141:

Omit “The Federal Court will shortly advise the applicant, the National Native Title Tribunal and other persons with an interest in the matter of the date, time and place of a directions hearing.’, substitute:

“A directions hearing in this appeal will be heard by the Court at the time and place specified below.

Time: (date and time to be entered by Registry)

Place: (address of Court)”.

8.   Third Schedule

8.1   Item 38:

Omit from column 2 “459M, 459M” substitute “459M”.

8.2   Item 38A:

Omit “465B” in column 2, substititute “465B, subsections 467 (1) and (3) and section 467A”.
