REGULATIONS UNDER THE FEDERAL COURT OF AUSTRALIA ACT 19761

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Federal Court of Australia Act 1976.

AMENDMENTS OF THE FEDERAL COURT OF AUSTRALIA REGULATIONS2

Fees

 Regulation 2 of the Federal Court of Australia Regulations is amended–

• (a)

  by omitting from paragraph (h) of sub-regulation (2) “ or ”;

• (b)

  by adding at the end of sub-regulation (2) the following word and paragraph:

 “; or (k) an application to the Court or a Judge for a direction to the Registrar or a District Registrar of the Court that he issue a certificate in accordance with sub‑regulation (4) ”; and

• (c)

  by omitting sub-regulation (4) and substituting the following sub-regulation:

• “ (4)

  A fee that, but for this sub-regulation, would be payable under this regulation is not payable where the Registrar or a District Registrar of the Court issues a certificate to the person who would otherwise be required to pay the fee certifying–

  • (a)

    that the person has been granted legal aid from a legal aid scheme or service approved by the Attorney-General; or

  • (b)

    that payment of the fee would impose substantial hardship on that person.”.
