Federal Court of Australia Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Federal Court of Australia Act 1976.

1.   Amendment

1.1   The Federal Court of Australia Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation

Act 1901, s 48.]

2.   Regulation 2 (Filing fees etc.)

2.1   Subregulation 2 (1A):

Omit the subregulation, substitute:

 “(1A) Unless the Court, a Judge, Judicial Registrar or Registrar orders otherwise:

• (a)

  the fee mentioned in item 13 of the Schedule is payable by the applicant in the proceedings to which the mediation relates; and

• (b)

  any other fee mentioned in the Schedule is payable by the person for whom the action is taken.”.

2.2   After subregulation 2 (1C), insert:

 “(1CA) A fee is not payable in relation to an appeal, mentioned in section 24 of the Federal Court of Australia Act 1976, from the judgment in an application referred to in subregulation (1C).”.

3.   Regulation 2AA (Setting down fees)

3.1   Paragraph 2AA (2) (d):

After “2 (1C),”, insert “2 (1CA),”.

4.   Regulation 2A (Hearing fees)

4.1   Paragraph 2A (2) (d):

After “2 (1C),”, insert “2 (1CA),”.

5.   Further amendments—Judicial Registrar

5.1   The Federal Court of Australia Regulations are further amended as set out in the following table.
