Federal Court of Australia Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Federal Court of Australia Act 1976.

Fees

1. Regulation 2 of the Federal Court of Australia Regulations is amended—

(a) by omitting paragraph (4) (a) and substituting the following paragraph:

“(a) that the person has been granted—

(i) legal or financial assistance under a law of the Commonwealth or of a Territory (other than the Northern Territory); or

(ii) legal aid from a legal aid scheme or service approved by the Attorney-General,

in relation to the proceedings in respect of which the fee would otherwise be payable or to which the service or execution of the process relates; or”; and

(b) by omitting from paragraph (4) (b) “substantial”.

Application

2. Regulation 1 applies to and in relation to proceedings commenced in the Court on or after the date on which these Regulations come into operation.
