1Name of Rules

These Rules are the Federal Court Amendment (Costs and Other Measures) Rules 2013.

2Commencement

Each provision of these Rules specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

These Rules are made under the Federal Court of Australia Act 1976.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Federal Court Rules 2011

1  Subrule 5.03(2)

Omit “A genuine”, substitute “The respondent’s genuine”.

2  After subrule 5.03(2) (before the notes)

Insert:

           (3)  The respondent’s genuine steps statement must be no more than 2 pages.

3  After subrule 8.02(2) (before the notes)

Insert:

           (3)  The applicant’s genuine steps statement must be no more than 2 pages.

4  Rule 10.04

After “lodged with”, insert “the”.

5  After Chapter 6

Insert:

Chapter 7—Transitional provisions

Note:     Provisions of this Chapter will be removed after they have expired.

Part 43—Transitional provisions

Division 43.1—Transitional provisions relating to the Federal Court Amendment (Costs and Other Measures) Rules 2013

43.01  Application of amendments relating to genuine steps statements

                 Subrules 5.03(3) and 8.02(3) apply in relation to proceedings started on or after 3 February 2014.

43.02  Expiry of this Division

                 This Division expires on 3 February 2015 as if it had been repealed by other Rules made under the Act.

Insert:

1A  Application of this Schedule

        1A.1  This Schedule, as amended by the Federal Court Amendment (Costs and Other Measures) Rules 2013, applies to work done or services performed on or after 1 January 2014.
