(NEW AGREEMENT AUTHORISATION)

AN ACT to amend the Schedule to the Federal Aid Roads (New Agreement Authorisation) Act, 1936, and for other purposes relating thereto.

RE it enacted by the King's Most Excellent Majesty, I' by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

(New Agreement Authorisation) Act Amendment Act,
1937, and shall be read as one with the Federal Aid Roads (New Agreement Authorisation) Act, 1936 (No. 33 of 1936), hereinafter referred to as the principal Act.

Amendment
| 2. The form of agreement contained in the Schedule to the principal Act is amended by deleting the whole of clauses four and five and inserting in lieu thereof new clauses as follow:— | of Schedule. |
(1.) All moneys paid to the State from the sums provided under subclause (1) of clause 2 of this agreement shall be expended upon the construc- tion, reconstruction, maintenance, or repair of roads.

(2.) All moneys paid to the State from the sums provided under subclause (2) of clause 2 of this agreement shall be expended upon the construction, reconstruction, maintenance, or repair of roads or other works connected with transport, as the State may think fit.
(1.) Whenever so required by the Minister, the State during the period of ten years commenc- ing on the first day of July, one thousand nine hund- red and thirty-seven, and not thereafter will, to the reasonable satisfaction of the Minister, make pro- vision for the proper maintenance and repair, to a standard necessary to meet the requirements of the Commonwealth and other traffic using such roads, of public roads adjoining, or of approach to, pro- perties of the Commonwealth within the State.

(2.) The State shall not be required to make any- provision under this clause
| (a) | in any year in excess of an amount equivalent to one-twelfth of the moneys paid to the State in that year from the sums provided under subclause (2) of clause 2 of this agreement; or |
| (b) | with respect to roads within the boundaries of |
the properties of the Commonwealth.
(3.) In this clause "properties of the Common- wealth" includes establishments, works, and activ- ities of the Commonwealth.
3. The provisions of section two of this Act shall have Retrospective
effect and shall be deemed to have had effect as from and so.protuttmosi
including the date of the commencement of the principal Act'
Act, and the Honourable the Premier of the State shall be deemed as from and including the said date to have been duly authorised for and on behalf of the State to execute an agreement in the form contained in the

Schedule to the principal Act as amended by the provi- sions of section two of this Act, as if the form of agree- ment as amended by the provisions of section two of this Act had originally been contaiired in the Schedule to the principal Act.
