W HEREAS, pursuant to the provisions of *" The Federal Aid Roads Agreement Approval Act of 1926," an Agreement (in this Act referred to as the " Principal Agreement") made on the second day of July, one thousand nine hundred and twenty-six, a copy whereof is set forth in the Schedule to such lastmentioned Act, between the Commonwealth of Australia and the State of Queensland in relation to the com;truction and reconstruction of Federal Aid Roads in the said State was approved, adopted, authorised, and ratified by the Parliament of the said State: And whereas, pursuant to the provisions of t"The Federal Aid Roads Agreement Approval Act (Variation of Agreement) Approval Act of 1931" a further Agreement referred to hereinafter as the" Amending Agreement" made and entered into on the eighteenth day of August, one thousand nine hundred and thirty-one, between the Commonwealth of Australia and the State of Queensland varying the "Principal Agreement" aJores:1id was approved, adopted, authorised, and ratified by the Parliament of the said State and being the Agreement set forth in the Schedule to t"The Federal Aid Roads Agreement Approval Act ( Variation of Agreement) Approval Act of 1931 " : * 17080. (Variation of .A greement) , Act. -- - ~ - - - - - - - - - - - -- ~ ~- - -- - -- - And "vhereas, subject to the approval, adoption, authorisation, or ratification by the Parliaments of the Commonwealth and the State of Queensland, a further Agreement was made and entered into on the twenty- eighth day of October, one thousand nine hundred and thirty-six, between the Commonwealth of Australia and the © State of Queensland varying the" Principal Agreement" as varied by the " Amending Agreement " entered into on the eighteenth day of August, one thousand nine hundred and thirty-one, a copy of such further Agreement so varying the " Principal Agreement " as varied by the "Amending Agreement" being as set forth in the Schedule to this Act: And whereas it is provided in the said Agreement dated the twenty-eighth day of October, one thousand nine hundred and thirty-six, that such Agreement shall have no force or effect and shall not be binding on either party unless and until it is approved, adopted, authorised, or ratified by the Parliaments of the Commonwealth and of the State: And whereas it is desirable that the said Agreement of the twenty-eighth day of October, one thousand nine hundred and thirty-six, varying the " Principal Agreement" (being the Agreement set forth in the Schedule to *"The Federal Aid Roads Agreement Approval Act of 1926 ") as varied by the" Amending Agreement" {being the Agreement set forth in the Schedule to t" The Federal Aid Roads Agreement Approval Act (Variation of Agreement) Approval Act of 1931 ") should be approved, adopted, authorised, and ratified by an Act of the Parliament of Queensland- Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament ass~ mbled, and by the authority of the same, as follows : - 1. AGREEMENT made the twenty-eighth day of October, one thousand nine hundred and thirty-six, BETWEEN THE COlVIMONWEALTH OF AUSTRALIA (in this Agreement calleJ " the Commonwealth ") and the STATE OF QUEENSLAND (in this Agreement called" the State ") : WHEREAS by an Agreement in the form contained in the Schedule to the Federal Aid Roads Act1926 of the Commonwealth and made on the second day of July, one thousand nine hundred and twenty-six, * 17 Geo. (Van'ation of Agreement), Act. between the Commonwealth and the State (which Agreement was approved, adopted, authorised, and ratified. by "The Pederal Aid Road8 Agreement Approval Act of 1926" of the State and is hereinafter called the" Principal Agreement "), it was agreed (inter alia) that the Commonwealth would subject to and for the purposes of the Agreement provide the sum therein mentioned during the period. of ten years commencing on the first day of July, one thousand. nine hundred and twenty-six: AND WHEREAS by an Agreement in the form contained. in the Schedule to the Pederal Aid Road8Act1931 of the Commonwealth and made on the eighteenth day of August, one thousand nine hundred and thirty-one, between the Commonwealth ani the State (which Agreement was approved, adopted, authorised, ani ratifiei by "The Federal Aid Road8 Agreement Approval Act (Variation of Agreement) Approval Act of 1931 " of the State and is hereinafter called the "Amending Agreement "), it was agreed that the "Principal Agreement" should be varied as therein provided: AND WHER~ AS by the" Principal Agreement" as varied by the " Amending Agreement" it is provided (l:nter alia)- (a) That the Commonwealth will subject to and for the purposes of the" Principal Agreement" as so varie::l provide during each year of the period of five years commencing on the first day of July, one thousand nine hundred and thirty-one. and during the period of six months commencing on the fjrst day of July, one thousand nine hundre:l and thirty-six, a sum calculated as therein provided; (b) That the Commonwealth shall in each ye~ u dLlring the said period of five years and also during the said period of six months commencing on the first d~ Ly of Jllly, one thousand nine hundred and thirty-six, withdraw from moneys in the Trust Account therein mentioned and pay into the Sinking Fund therein mentioned an amount calculated as therein provided; and (c) That the State shall on the date therein mentioned in each year after the expiration of the said periods of five years and six months pay into the said Sinking Fund an amount calculated as therein provided until the eondi.tions therein mentioned are fulfilled. AND WHEREAS the Commonwealth and the State have agreed to vary the "Principal Agreement" as varied by the "Amending Agreement" in the manner hereinafter appearing: Now IT IS HEREBY AGREED as follows:- 1. This Agreement shall have no force or effect and shall not be binding on either party unless and until it is approved, adopted, authorised, or ratified by the Parliaments of the Commonwealth and of thc State. 2. The "Principal Agreement" as varied by the "Amending Agreement" shall be read and construed as if wherever the words" six months" appear therein the words" twelve months" were inserted in lieu thereof. ]6339

Subject to the variations made by this Agreement, the " Principal Agreement" as varied by the " Amending Agreement" shall be of full force and effect.
