s1 2 s4 Fauna Conservation Amendment (No. 1) No. 143, 1994 ˙ Short title 1. This regulation may be cited as the Fauna Conservation Amendment Regulation (No. 1) 1994 . ˙ Regulation amended 2. This regulation amends the Fauna Conservation Regulation 1989 . ˙ Replacement of ss 36B and 36C 3. Sections 36B and 36C— omit, insert— ˙ Open season declared 36B. An open season is declared under section 29 (Power of Governor in Council) of the Act for the period starting on 25 June 1994 and ending on 18 September 1994. ˙ Where open season applies 36C. The open season applies in all fauna districts other than the fauna districts of Atherton, Aurukun, Barcoo, Brisbane, Bulloo, Burnett, Cairns, Caloundra, Charters Towers, Cooloola, Dalby, Diamantina, Douglas, Eacham, Gladstone, Gold Coast, Goondiwindi, Herberton, Ipswich, Johnstone, Logan, Mackay, Mareeba, Maroochy, Mornington, Mulgrave, Noosa, Paroo, Quilpie, Redcliffe, Redland, Rockhampton, Roma, Toowoomba, Torres, Townsville and Warwick.’. ˙ Amendment of s 36D (Terms, conditions etc. for taking, moving and keeping ducks) 4. Section 36D(1)— omit, insert— Terms and conditions for taking, moving and keeping ducks 36D.(1) The following terms, conditions and restrictions apply to the taking, moving and keeping of ducks—
s5 3 s5 Fauna Conservation Amendment (No. 1) No. 143, 1994 (a) a person may take a duck only by shooting it with a shotgun; (b) a shotgun used by a person for shooting a duck must be no more than 12 gauge in size; (c) a person must not use a tethered live duck as a decoy; (d) a gun dog may be used for retrieving a duck only if it is of a recognised game retrieval breed; (e) an injured duck must be killed immediately on retrieval; (f) a person must not sell a duck or offer a duck for sale; (g) a person must not take a duck before 6.00 am or after 6.00 pm on a day; (h) a person must not take more than 12 ducks a day, regardless of species; (i) a person must not have in possession at a place other than the person’s usual place of residence more than 30 ducks, regardless of species; (j) ducks may be moved from the place of taking only to— (i) the place being used as a temporary camping place by the person who took the ducks; or (ii) the usual place of residence of the person who took the ducks; (k) either a wing or the head of each duck must remain fully feathered and attached to the carcass of the duck until the carcass is moved to the usual place of residence of the person who took the duck, or until it is prepared for cooking, whichever happens first; (l) a person who takes ducks must give written notice to the Director not later than 1 month after the end of the open season advising the number taken of each species.’. ˙ Replacement of ss 36F and 36G 5. An open season is declared under section 29 (Power of Governor in Council) of the Act for the period starting on 14 May 1994 and ending on 7 August 1994. ˙ Where open season applies 36G. The open season applies in all fauna districts other than the fauna districts of Atherton, Aramac, Aurukun, Balonne, Barcaldine, Barcoo, Booringa, Boulia, Brisbane, Bulloo, Bundaberg, Burdekin, Burke, Burnett, Cairns, Caloundra, Cardwell, Carpentaria, Charters Towers, Cloncurry, Cook, Cooloola, Croydon, Dalby, Dalrymple, Diamantina, Douglas, Eacham, Etheridge, Flinders, Gladstone, Gold Coast, Goondiwindi, Herberton, Hinchinbrook, Ilfracombe, Ipswich, Isisford, Johnstone, Logan, Longreach, Mackay, Mareeba, Maroochy, McKinlay, Mirani, Mornington, Mount Isa, Mulgrave, Murweh, Noosa, Paroo, Quilpie, Redcliffe, Redland, Richmond, Rockhampton, Roma, Sarina, Tambo, Toowoomba, Torres, Townsville, Warroo, Warwick and Winton.’. ˙ Amendment of s 36H (Terms, conditions etc. for taking, moving and keeping quails) 6. Section 36H(1)— omit, insert Terms and conditions for taking, moving and keeping quails 36H.(1) The following terms, conditions and restrictions apply to the taking, moving and keeping of quails— (a) a person may take a quail only by shooting it with a shotgun; (b) a shotgun used by a person for shooting a quail must not be more than 12 gauge in size; (c) a gun dog may be used for flushing and retrieving a quail only if it is a recognised game retrieval breed; (d) an injured quail must be killed immediately on retrieval; (e) a person must not take a quail before 6.00 am or after 6.00 pm on a day;
s6 5 s6 Fauna Conservation Amendment (No. 1) No. 143, 1994 (f) a person must not take more than 25 quails in a day, regardless of species; (g) a person must not sell a quail or offer a quail for sale; (h) a person must not have in possession at a place other than the person’s usual place of residence more than 60 quails, regardless of species; (i) quails may be moved from the place of taking only to— (i) the place being used as a temporary camping place by the person who took the quails; or (ii) the usual place of residence of the person who took the quails; (j) either the head, which must remain fully feathered, or the feet of each quail must remain attached to the carcass of the quail until the carcass is moved to the usual place of residence of the person who took the quail, or until it is prepared for cooking, whichever happens first; (k) a person who takes quails must give written notice to the Director not later than 1 month after the end of the open season advising the number taken of each species.’.
