2 Fauna Conservation Amendment (No. 1) No. 226, 1993 ˙ Short title 1. This regulation may be cited as the Fauna Conservation Amendment Regulation (No. 1) 1993 . 1 ˙ Amended regulation 2. The Fauna Conservation Regulation 1989 is amended as set out in this regulation. ˙ Insertion of new Parts 6A and 6B 3. After Part 6— insert— ‘PART 6A—OPEN SEASON (DUCK) ˙ ‘Application ‘36A. This Part applies to the following species of duck— (a) Black duck, also called Australian wild duck, Australian black duck, wild duck, brown duck or grey duck ( Anas superciliosa ); (b) Maned wood duck, also called wood duck or maned goose ( Chenonetta jubata ); (c) Grey teal, also called Australian grey teal, wood teal or slender teal ( Anas gibberifrons ); (d) Grass whistling duck, also called plumed tree duck, plumed whistling duck, eytons tree duck or grass whistler ( Dendrocygna eytoni ); (e) Water whistler, also called whistling tree duck, tree duck, red whistler or Australian wandering whistling duck ( Dendrocygna arcuata ); (f) White-eyed duck, also called white-eye, hardhead or widgeon ( Aythya australis ). 1 See s.20A of the Statutory Instruments Act 1992.
3 Fauna Conservation Amendment (No. 1) No. 226, 1993 ˙ ‘Open season declared ‘36B. An open season is declared under section 29 of the Act for the period starting on 26 June 1993 and ending on 19 September 1993. ˙ ‘Where open season applies ‘36C. The open season applies in all fauna districts other than the fauna districts of Atherton, Aurukun, Barcoo, Brisbane, Bulloo, Cairns, Caloundra, Charters Towers, Dalby, Diamantina, Douglas, Eacham, Gladstone, Gold Coast, Goondiwindi, Gympie, Herberton, Ipswich, Johnstone, Logan, Mackay, Mareeba, Maroochy, Mornington, Mulgrave, Noosa, Paroo, Quilpie, Redcliffe, Redland, Rockhampton, Roma, Toowoomba, Torres, Townsville, Warwick, Widgee and Woongarra. ˙ ‘Terms, conditions etc. for taking, moving and keeping ducks ‘36D.(1) The following terms, conditions and restrictions apply to the taking, moving and keeping of ducks— (a) a person must not take a duck by a means other than shooting with a shotgun; (b) a person must not use a tethered live duck as a decoy; (c) a person must not sell a duck or offer a duck for sale; (d) a person must not take more than 6 ducks, regardless of species, in a period of 24 hours; (e) a person must not have in possession at a place other than the person’s usual place of residence more than 30 ducks, regardless of species; (f) ducks may be moved from the place of taking only to— (i) the place being used as a temporary camping place by the person who took the ducks; or (ii) the usual place of residence of the person who took the ducks; (g) either a wing or the head of each duck is to remain fully feathered and attached to the carcass of the duck until the carcass is moved
4 Fauna Conservation Amendment (No. 1) No. 226, 1993 to the usual place of residence of the person who took the duck, or until it is prepared for cooking, whichever happens first; (h) a person who takes ducks must give written notice to the Director not later than 1 month after the end of the open season advising the number taken of each species. ‘(2) An open season fauna permit relating to the taking of ducks is subject to the condition that, if the holder does not take a duck under the permit, the holder must give to the Director, not later than 1 month after the end of the open season, written notice to the effect that no ducks were taken. ‘PART 6B—OPEN SEASON (QUAIL) ˙ ‘Application ‘36E. This Part applies to the following species of quail— (a) Stubble quail ( Coturnix novaezelandiae ); (b) Brown quail ( Coturnix australis ). ˙ ‘Open season declared ‘36F. An open season is declared under section 29 of the Act for the period starting on 26 June 1993 and ending on 19 September 1993. ˙ ‘Where open season applies ‘36G. The open season applies in all fauna districts other than the fauna districts of Atherton, Aramac, Aurukun, Balonne, Barcaldine, Barcoo, Booringa, Boulia, Brisbane, Bulloo, Bundaberg, Burdekin, Burke, Cairns, Caloundra, Cardwell, Carpentaria, Charters Towers, Cloncurry, Cook, Croydon, Dalby, Dalrymple, Diamantina, Douglas, Eacham, Etheridge, Flinders, Gladstone, Gold Coast, Goondiwindi, Gympie, Herberton, Hinchinbrook, Ilfracombe, Ipswich, Isisford, Johnstone, Logan, Longreach, Mackay, Mareeba, Maroochy, McKinlay, Mirani, Mornington, Mount Isa, Mulgrave, Murweh, Noosa, Paroo, Pioneer, Quilpie, Redcliffe, Redland,
5 Fauna Conservation Amendment (No. 1) No. 226, 1993 Richmond, Rockhampton, Roma, Sarina, Tambo, Toowoomba, Torres, Townsville, Warroo, Warwick, Widgee, Winton and Woongarra. ˙ ‘Terms, conditions etc. for taking, moving and keeping quails ‘36H.(1) The following terms, conditions and restrictions apply to the taking, moving and keeping of quails— (a) a person must not take a quail by a means other than shooting with a shotgun; (b) a person must not sell a quail or offer a quail for sale; (c) a person must not take more than 13 quails, regardless of species, in a period of 24 hours; (d) a person must not have in possession at a place other than the person’s usual place of residence more than 60 quails, regardless of species; (e) quails may be moved from the place of taking only to— (i) the place being used as a temporary camping place by the person who took the quails; or (ii) the usual place of residence of the person who took the quails. (f) either a wing or the head of each quail is to remain fully feathered and attached to the carcass of the quail until the carcass is moved to the usual place of residence of the person who took the quail, or until it is prepared for cooking, whichever happens first; (g) a person who takes quails must give written notice to the Director not later than 1 month after the end of the open season advising the number taken of each species. ‘(2) An open season fauna permit relating to the taking of quails is subject to the condition that, if the holder does not take a quail under the permit, the holder must give to the Director, not later than 1 month after the end of the open season, written notice to the effect that no quails were taken. ’.
