FAUNA CONSERVATION.

No. 53 of 1970.

AN ACT to amend the Fauna Conservation Act,

1950-1969.

[Assented to 5th November, 1970.]

RE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Fauna

and citation.

(2) In this Act the Fauna Conservation Act, 1950- 1969, is referred to as the principal Act.

paragraph as f ollows-

(ba) The Minister may, from time to time by notice published in the Government Gazette, declare that any fauna specified in the notice is for the purposes of this Act fauna which is rare and likely to become extinct and while such declaration is in operation-

(i)  such fauna is wholly protected throughout the whole of the State at all times; and

(ii)    a person who commits an offence under section sixteen of this Act with respect to or in relation to such fauna is liable, notwithstanding any other provision of this Act, to a penalty of one thousand dollars. .

4. Subsection (1) of section 16 of the principal next succeeding section, or of section twenty-three" in lines eight and nine the passage "section seven- teen, or of section twenty-three of this Act".
