GAUDRON J:   This case was heard in Hobart on 30 and 31 March 1998 by a Court constituted by Justices McHugh, Kirby, Hayne, Callinan and myself.  We are in a position to make orders in this matter.  We will, however, publish our reasons for judgment in due course.

The orders of the Court are:

1.        Appeal allowed.

2.Set aside the orders of the Court of Criminal Appeal of Tasmania and in lieu thereof allow the appeal to that court, quash the convictions and order a new trial on counts 1, 2, 3, 4, 5 and 6.
