Farm Produce Agents (Amendment) Act 1960 (NSW)

FARM PRODUCE AGENTS (AMENDMENT) ACT.

Act No. 3 ,1960.

An Act to make further provisions with respect to the sale of farm produce; for this purpose to amend the Farm Produce Agents Act, 1926, as amended by subsequent Acts; and for purposes connected therewith. [Assented to, 24th March, 1960.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative	Council and Legislative Assembly of New South Wales in
Parliament assembled, and by the authority of the same, as follows : —
1. (1) This Act may be cited as the "Farm Produce Agents (Amendment) Act, 1960".
(2) The Farm Produce Agents Act, 1926, as amended by subsequent Acts and by this Act, may be cited as the Farm Produce Agents Act, 1926-1960.
2. The Farm Produce Agents Act, 1926, as amended by subsequent Acts, is amended—

(b)

(a) by inserting at the end of section 29A the following new paragraph : —

Regulations may be made under this Act providing that this section shall not apply to persons making such purchases of such classes of farm produce as may be specified in such regulations, in all circum­ stances or in such circumstances as may be so specified, and while any such regulation is in force this section shall not apply accordingly.

(b) (i) by inserting next after subsection (1A) of section

thirty-two the following new subsection : —

(1B) Any regulation made under this Act with respect to the keeping of books or records or the delivery by vendors to purchasers of any dockets or documents or the retention of any dockets or documents may provide that such regulation shall not apply to persons making such purchases or sales of such classes of farm produce as may be specified in such regulation, in all circumstances or in such circumstances as may be so specified.

(ii)   by omitting from subsection two of the same section the word "Such" and by inserting in lieu thereof the word "The" ;

(iii)   by omitting from subsection three of the same section the word "Such" and by inserting in lieu thereof the word "The" ;

(iv)   by omitting from paragraph (b) of the same subsection the word "such" and by inserting in lieu thereof the word "the".
