FARM PRODUCE ACT 1983 - REGULATION

(Relating to the Flemington Markets Commercial Services Scheme)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Farm Produce Act 1983, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 15 February 1991.

Amendments

2. The Farm Produce Regulation 1983 is amended by inserting after

clause 16 the following clause:

Flemington Markets Commercial Services Scheme

16A. For the purposes only of section 51 (1) (b) of the Trade Practices Act 1975 of the Commonwealth, the making of or giving of effect to a contract or arrangement or the arriving at or giving of effect to an understanding concerning:

(a) the marketing of farm produce; and (b) the adoption of marketing practices,

in accordance with by-laws in or to the effect of the by-laws made by Flemington Markets Commercial Services Co-operative Limited (formerly known as Sydney Markets

Credit Co-operative Limited) in respect of the Flemington Markets Commercial Services Scheme and known as the "Flemington Markets Commercial Services Scheme By-law" (as amended from time to time), is approved.

EXPLANATORY NOTE

The object of this Regulation is to enable the establishment and operation by the Flemington Markets Commercial Services Co-operative Limited of a credit management scheme relating to the marketing of farm produce on credit at Flemington Markets. The scheme is to be restricted to shareholders in the Co-operative who choose to participate and will enable fruit and vegetables to be purchased on credit.
