Farm Household Support (South Australian River Murray Sustainability Irrigation Industry Improvement Program) Minister’s Rule 2015

I, Barnaby Joyce, Minister for Agriculture, make the following rule for the purposes of section 92 of the Farm Household Support Act 2014.

1Name of rule

This rule is the Farm Household Support (South Australian River Murray Sustainability Irrigation Industry Improvement Program) Minister’s Rule 2015.

2Commencement

This rule commences on the day after it is registered.

3Authority

This rule is made under the Farm Household Support Act 2014.

4Modifications of Division 9 of Part 3 of the Social Security (Administration) Act 1999

1. (1)

   Section 109 of the Social Security (Administration) Act 1999, in its application in relation to payments made under the Farm Household Support Act 2014, is modified as if the following 2 subsections ((5A) and (5B)) were inserted.

2. (5A)

   If:

   1. (a)

      a decision (the original decision) is made in relation to a person’s social security payment; and

   2. (b)

      the Secretary reviews the decision under section 126 without any application under section 129 for review of the decision having been made; and

   3. (c)

      as a result of the review, a favourable determination is made; and

   4. (d)

      the favourable determination is occasioned by the operation, before the determination, of the Social Security (Exempt Lump Sum) (South Australian River Murray Sustainability Irrigation Industry Improvement Program) (Agriculture) Determination 2015;

   then:

   1. (e)

      subsection (5) does not apply; and

   2. (f)

      the favourable determination takes effect on the day on which the determination embodying the original decision took effect.

3. (5B)

   If:

   (a) a determination under section 78 is occasioned by the operation, before the determination, of the Social Security (Exempt Lump Sum) (South Australian River Murray Sustainability Irrigation Industry Improvement Program) (Agriculture) Determination 2015; and

   (b) the determination is neither the result of a review under section 126 nor the result of a review under section 135;

   the determination takes effect on the day specified in the determination.

4. (2)

   The 2 subsections apply subject to any modifications of the social security law made by Part 5 of the Farm Household Support Act 2014.
