Family Violence Protection Act 2008

Family Violence Protection Amendment Regulations 2018

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Family Violence Protection Regulations 2008, as a consequence of the enactment of the Family Violence Protection Amendment Act 2017—

(a)to revoke redundant provisions; and

(b)to update the form certifying non-attendance at a counselling assessment interview.

2Authorising provision

These Regulations are made under section 211 of the Family Violence Protection Act 2008.

3Commencement

These Regulations come into operation on 29 March 2018.

4Principal Regulations

In these Regulations, the Family Violence Protection Regulations 2008[1] are called the Principal Regulations.

5Regulation 9 revoked

Regulation 9 of the Principal Regulations is revoked.

6Regulation 10A revoked

Regulation 10A of the Principal Regulations is revoked.

7Form 2 revoked

Form 2 of the Principal Regulations is revoked.

8Form 2A revoked

Form 2A of the Principal Regulations is revoked.

9Amendment to Form 3

In Form 3 of the Principal Regulations, for "[name of person specified in the order to perform the assessment] am a person who is approved by the Secretary to the Department of Justice under section 133" substitute "[name of the counselling assessor at the relevant location], am a counselling assessor within the meaning of section 129(7)".
