1  Name

This instrument is the Family Law (Superannuation) (Provision of Information — NSW State Authorities Non-contributory Superannuation Scheme) Amendment Determination 2019.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under subregulation 64(7) of the Family Law (Superannuation) Regulations 2001.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Family Law (Superannuation) (Provision of Information — NSW State Authorities Non‑contributory Superannuation Scheme) Determination 2010

1  Subsection 3(1)

Insert:

basic benefit has the same meaning as in subsection 3(1) of the NSW State Authorities Non‑contributory Superannuation Act.

2  Subsection 3(1)

Repeal the following definitions:

(a)  definition of Commonwealth co‑contribution account;

(b)  definition of STC.

3  Section 5 (table item 1, column headed “Superannuation interest”)

Omit “An”, substitute “The basic benefit component of an”.

4  Section 5 (table item 1, column headed “Information that must be provided”, subparagraph (e)(iv))

Omit “1988;”, substitute “1988”.

5  Section 5 (table item 1, column headed “Information that must be provided”, paragraphs (f) and (g))

Repeal the paragraphs.

6  At the end of section 5 (after the table)

Add:

Note:          For item 1 of the table, information in respect of other components of the interest may be required to be provided under regulation 63 of the Regulations.
