WE, Judges within the meaning of section 123 of the Family Law Act 1975,hereby, under that Act and pursuant to section 4 of the Acts Interpretation Act 1901 make the following Rules of Court.

Title of documents

1. Rule 3 of Order 7 of the Family Law Rules is amended:

(a) by omitting from subrule (1) “subrules (2) and (2a)” and substituting “this rule”;

(b) by omitting from subrule (1) “33,”;

(c) by omitting from subrule (2a) “Where” and substituting “Subject to subrule (2c), where”; and

(d) by inserting after subrule (2a) the following subrules:

“(2b) Subject to subrule (2c), a document relating to an application for an order under section 64, 66f or 66n or subsection 66z (1) of the Act, other than a document in the nature of Form 31, 32, 34, 35 or 42, to be filed in, or issued out of, a registry of a court shall be entitled in accordance with Form 1c.

“(2c) Where:

(a) the words '(Short title)' appear immediately below the heading to a form in the Schedule; and

(b) the form is to be filed in relation to an application for an order under section 64, 66f or 66n or subsection 66z (1) of the Act;

a document in accordance with that form is to be entitled in accordance with Form 1d.”.

Filing of marriage certificate or other document with application

2. Rule 5 of Order 7 of the Family Law Rules is amended by inserting after subrule (1) the following subrule:

“(1a) Subrule (1) does not apply unless the application is filed in a matrimonial cause or in proceedings between parties to a marriage that has been annulled or dissolved.”.

Institution of summary maintenance proceedings

3. Rule 1 of Order 9 of the Family Law Rules is amended by omitting “to, or a child of, a marriage” and substituting “to a marriage, or a child,”.

Notice to particular persons in proceedings relating to children

4.Rule 5 of Order 14 of the Family Law Rules is amended by omitting from paragraph (k) “sub-section 10 (1)” and substituting “subsection 60h (1)”.

Contents of affidavit

5.Rule 3 of Order 16 of the Family Law Rules is amended:

(a) by omitting from paragraph (1) (a) “to the marriage and”;

(b) by inserting after paragraph (1) (a) the following paragraph:

“(aa) if the parents of the child or children are not parties to the proceedings—the full name, address and age of each parent;”;

(c) by omitting from paragraph (1) (b) “children of the marriage” and substituting “child or children”;

(d) by omitting paragraph (1) (c) and substituting the following paragraph:

“(c) the dates of the periods of cohabitation (if any) between the parents of the child or children;”; and

(e) by omitting from paragraph (1) (e) “children” and substituting “child or children”.

Contents of affidavit

6.Rule 9 of Order 16 of the Family Law Rules is amended by omitting from paragraph (a) “sub-section 75 (2) and sections 72, 76 and” and substituting “sections 66d, 66e, 66g and 72, subsection 75 (2) and section”.

7. After Rule 9 of Order 16 of the Family Law Rules the following rule is inserted:

Affidavit for purposes of section 66x of the Act

“9a. (1) There shall be filed with an application for the purposes of section 66x of the Act an affidavit specifying concisely, and confined to, facts relevant to the matters referred to in paragraphs (a), (b), (c) and (d) of that section and in subsection 66y (1).

“(2) Where:

(a) a mother has died and the death is as a result of a pregnancy or birth; and

(b) an affidavit is filed with an application for the purposes of section 66x of the Act in relation to the expenses of the mother;

the affidavit shall set out the grounds on which the person filing the affidavit claims standing to do so.

Statement or affidavit of financial circumstances

8.Rule 2 of Order 17 of the Family Law Rules is amended:

(a) by omitting from subparagraph (d) (iv) “of the marriage” (wherever occurring);

(b) by omitting from subparagraph (d) (x) “spouse, or former spouse, of the deponent,” and substituting “other party,”; and

(c) by omitting from subparagraph (d) (xi) “spouse, or former spouse, of the deponent” and substituting “other party”.

Children to whom subsection 60H (1) of the Act applies

9. Rule 2 of Order 23 of the Family Law Rules is amended by omitting from subrule (1) “sub-section 10 (1)” and substituting “subsection 60h (1)”.

10. Rule 2 of Order 25 of the Family Law Rules is repealed and the following rule substituted:

Notice seeking counselling

“2. A notice filed in the Family Court or in a Family Court of a State under subsection 15 (1) or 61 (1) or a request under subsection 16 (2) of the Act shall be in accordance with Form 32.”.

Advice as to effect of proceedings

11.Rule 3 of Order 25 of the Family Law Rules is amended:

(a) by omitting from subrule (1) “section 17” and substituting “sections 17 and 61c”; and

(b) by inserting after subrule (2) the following subrule:

“(2a) Documents prepared before the commencement of this provision for the purposes of section 17 of the Act and setting out the matters referred to that section shall be taken to have been prepared in accordance with directions given by the Chief Judge under subrule (1)”; and

(c) by omitting from subrules (3), (4) and (5) “section 17 of the Act as is” and substituting in each of those subrules “sections 17 and 61c of the Act as are”.

Reports of court counsellors

12.Rule 5 of Order 25 of the Family Law Rules is amended by omitting from subrule (1) “sub-section 63 (2)” and substituting “subsection 55a (2)”.

Registration of agreement under section 66zc or 86 of the Act

13.Rule 1 of Order 26 of the Family Law Rules is amended:

(a) by omitting from subrule (1) “A maintenance agreement” and substituting “A child agreement to which section 66zc of the Act applies or a maintenance agreement”; and

(b) by omitting from subrule (2) “a maintenance agreement” and substituting “a child agreement or a maintenance agreement”.

Maintenance orders

14.Rule 9 of Order 31 of the Family Law Rules is amended by omitting “or child of a marriage,” and substituting “a marriage, or a child,”.

Enforcement of maintenance, etc. and orders under section 109

15.Rule 2 of Order 33 of the Family Law Rules is amended by omitting paragraph (1) (a) and substituting the following paragraph:

“(a) an order that a party pay maintenance or other money for the benefit of the other party, or of a child, and an order under section 109 of the Act;”.

16. Order 33 of the Family Law Rules is amended by adding at the end the following rule:

Payment into court by order

“10. Where a party to proceedings pays money into court pursuant to paragraph 66j (1) (f), 66z (2) (e) or 80 (f) of the Act, the party must file a notice of payment in accordance with Form 46a.

Particulars of employment and earnings

17.Rule 3 of Order 40 of the Family Law Rules is amended by omitting from subrule (2) “Part VIII” and substituting “Part VII, VIII”.
