Family Law Rules 2(Amendment)

WE, Judges within the meaning of the Family Law Act 1975, make the following Rules of Court under that Act.

1.   Amendment

1.1   The Family Law Rules are amended as set out in these Rules.

[NOTE:

 These Rules commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Order 34, rule 7 (Who may take proceedings)

2.1   Omit the rule, substitute:

Who may take proceedings

 “7.(1) Application may be made to the court, by filing an application, in accordance with Form 48 or Form 49, that any person alleged to have committed an offence or to be guilty of a failure to comply of a kind referred to in subrule 6 (1) or to have failed to comply with any other order made by the court or with a condition of a recognizance, be dealt with for that offence or failure to comply.

 “(2) Application to the court under subrule 7 (1):

  • (a)

    may be made by:

    • (i)

      the Marshal; or

    • (ii)

      a member of the Australian Federal Police; or

    • (iii)

      a member of a police force of a State or Territory; or

    • (iv)

      an officer of the Attorney-General’s Department; or

  • (b)

    at the direction of a Family Court—must be made by the Marshal.”.
