Family Law Rules 2(Amendment)

WE, Judges within the meaning of the Family Law Act 1975, make the following Rules of Court under that Act.

1.   Commencement

1.1   These Rules commence on 4 April 1994.

2.   Amendment

2.1   The Family Law Rules are amended as set out in these Rules.

3.   Order 32a, rule 3 (Time for filing an application)

3.1   Paragraph 3 (a):

Omit “21 days”, substitute “one month”.

4.   Order 36a, rule 2 (Delegation of powers to Registrars)

4.1   Paragraph 2 (1) (g):

Omit “proceedings;”, substitute “proceedings, including orders to which subsection 64 (1c) of the Act applies;”.

4.2   Subrule 2 (2):

After paragraph (2) (mb), insert:

  • “(mc)

    Order 35, rule 4, in respect of a person arrested on a warrant that a Registrar has power to order;”.

5.   Order 36a, rule 3 (Delegation of powers to Judicial Registrars)

5.1   Add at the end:

“; (zb)

Order 34, rules 3 and 4 and Order 35, rule 4.”.

6.   Order 38, rule 38 (Accounts and taxation)

6.1   After subrule 38 (4), insert:

“(4A)

Nothing in this Order is taken to require a solicitor to serve more than one notice of rights if each account rendered in the course of the proceedings, subsequent to the service of a notice of rights, includes an endorsement drawing attention to the notice of rights.”.

7.   Schedule 1

7.1   Form 44:

Omit “(set out order to be reviewed)” (twice occurring), substitute “(set out order to be reviewed and date of order)”.

6[MG3] .2   Form 55:

Before “Dated this”, insert:

“I *have/*have not notified my client that the matter is next listed before the court on (date) for (action) .”.

6.3   Form 55:

Add at the end:

“* Omit if inapplicable”.

6.4   Form 59:

Omit “(or Deputy Registrar)”, substitute “(or clerk in the Registry)”.

6.5   Form 59:

Omit “Registrar/Deputy Registrar”, substitute “Registrar/Registry clerk”.
