I, The Governor-General of the Commonwealth of Australia, acting with the advice of the
Federal Executive Council, make the following Regulations under the
Dated 19 November 1996.

1.1 These regulations commence on 1 December 1996.
2.1 The Family Law Regulations are amended as set out in these Regulations.
3.1 The amendments of the Family Law Regulations made by subregulations 4.2, 4.4, 4.5, 4.6 and 4.7 of these Regulations apply, in relation to a proceeding in the Family Court of Australia, to a fee payable in the proceeding on or after 1 September 1996.
4.1 Subparagraph 11 (1) (a) (i):
Omit “$460”, substitute “$500”.
4.2 Subparagraph 11 (1) (a) (ii):
Omit “$400”, substitute “$300”.
4.3 Subparagraph 11 (1) (b) (i):
Omit “$460”, substitute “$500”.
4.4 Subparagraph 11 (1) (b) (ii):
Omit “$400”, substitute “$300”.
4.5 Subparagraph 11 (1) (c) (i):
Omit “$250”, substitute “$150”.
4.6 Subparagraph 11 (1) (c) (ii):
Omit “$400”, substitute “$300”.
4.7 Paragraph 11 (1) (d):
Omit “$400”, substitute “$300”.
4.8 Subregulation 11 (4):
Omit the subregulation, substitute:
“
(a) if the Court or Registrar directs a time within which the fee must be paid—within that time; or
(b) in any other case—at the time when a date is fixed for the hearing of the proceedings.”.
5.1 Subregulation 21AB (2) (definition of “fee”):
Omit “during”, substitute “at the end of”.
6.1 This regulation applies to a person who has paid a fee under subparagraph 11 (1) (a) (ii), (b) (ii), (c) (i) or (c) (ii), or paragraph 11 (1) (d), of the Old Regulations, in respect of a proceeding in the Family Court of Australia.
6.2 The person may request the Registrar of the Court at which the fee was paid for a refund of the amount that is the difference between the amount of the fee paid by the person and the amount of the fee payable for the proceeding immediately after the commencement of these Regulations.
6.3 A request must be in writing and accompanied by:
(a) a receipt; or
(b) other evidence of payment of the fee.
6.4 As soon as practicable after receiving a request, the Registrar must pay the appropriate refund to the person.
