Family Law (Child Abduction Convention) Regulations (Amendment) (Cth)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the
Federal Executive Council, make the following Regulations under the
Dated 29 May 1996.

1.1 These Regulations commence on 11 June 1996.
2.1 The Family Law (Child Abduction Convention) Regulations are amended as set out in these Regulations.
3.1 Add at the end:
“
(a) guardianship of the child; and
(b) responsibility for long term, or day-to-day, care, welfare and development of the child; and
(c) responsibility as the person or persons with whom the child is to live.”.
4.1 Omit all the words after “interim order,”, substitute “providing for the custody of the child, within the meaning of regulation 18, until the application is determined.”.
5.1 Paragraph 26 (1) (a):
Omit “court counsellor”, substitute “family and child counsellor”.
5.2 Subregulation 26 (2):
Omit “court counsellor”, substitute “family and child counsellor”.
5.3 Subregulation 26 (2):
Omit “welfare”, substitute “care, welfare or development”.
5.4 Subregulation 26 (3):
Omit “court counsellor”, substitute “family and child counsellor”.
5.5 Subregulation 26 (4):
Omit “court counsellor”, substitute “family and child counsellor”.
5.6 Subregulation 26 (5):
Omit “court counsellor”, substitute “family and child counsellor”.
5.7 Add at the end:
“
(a) relates to the welfare of the child; and
(b) under subregulation (2)—is included in a report.”.
6.1 Paragraph 29 (1) (b):
After “witness”, insert “who resides outside Australia”.
6.2 Add at the end:
“
(a) guardianship of the child; and
(b) responsibility for long term, or day-to-day, care, welfare and development of the child; and
(c) responsibility as the person or persons with whom the child is to live.”.
