Family Law Amendment Rules 1998 (No. 2)

We, Judges within the meaning of the Family Law Act 1975, make the following rules of court under that Act.

1.   Name of rules

1.1   These rules are the Family Law Amendment Rules 1998 (No. 2).

2.   Commencement

2.1   These rules commence on gazettal.

3.   Amendment

3.1   The Family Law Rules2 are amended as set out in these rules.

4.   Order 38, rule 40 (Service of bill by costs receiver (except under a costs agreement))

4.1   After subrule 40 (3), insert:

 “(3A) A request for a bill to be served must be made within 28 days after the later of:

• (a)

  the day on which an account for the costs was served; and

• (b)

  the day on which a notice of rights was served.”.
