1Name of Regulations

 These Regulations are the Family Law Amendment Regulations 2001 (No. 3).

2Commencement

 These Regulations commence as follows:

• (a)

  on gazettal — regulations 1 to 3 and Schedule 1;

• (b)

  on 1 January 2002 — Schedule 2.

3Amendment of Family Law Regulations 1984

 Schedules 1 and 2 amend the Family Law Regulations 1984.

  The filing fee payable for a proceeding for a decree of dissolution of marriage is $250 if the proceeding is:

  • (a)

    instituted in a prescribed court mentioned in paragraph 10A (2) (a) or (c); or

  • (b)

    instituted in another court for transfer to a prescribed court mentioned in paragraph 10A (2) (a) or (c).

Note   The fee payable under this subregulation is subject to increase under Part IIAA.

12ACTransfer of property proceedings from the Federal Magistrates Court — specified value

• (1)

  This regulation applies in relation to proceedings instituted in the Federal Magistrates Court on or after 1 January 2002.

• (2)

  For subparagraph 45A (1) (a) (ii) of the Act, the amount of $700 000 is specified.
