Family Assistance (Vaccination Schedules) (FaHCSIA) Determination 2012

Part 1                 Preliminary

1. Name of Determination

This Determination is the Family Assistance (Vaccination Schedules) (FaHCSIA) Determination 2012.

1. Commencement

This Determination commences on 1 July 2012.

1. Definitions

In this Determination:

Australian Register of Therapeutic Goods means the register maintained under section 9A of the Therapeutic Goods Act 1989.

Hib means Haemophilus influenzae type b.

National Health and Medical Research Council means the council established by section 5B of the National Health and Medical Research Council Act 1992.

4              Application

(1)   This Determination applies to Family Tax Benefit (FTB) Part A supplement.

(2)   This Determination applies to all claims for FTB Part A supplement made after 30 June 2012.

Part 2                 Vaccination schedules

1. Standard vaccination schedule

(1)   Subject to subsections (5) to (7), Schedule 1 is the standard vaccination schedule for children born before 1 July 2013 who turns 1 in the relevant income year under which a child must be vaccinated against a disease or antigen mentioned in an item at the age mentioned in that item.

(2)   Subject to subsections (5) to (7), Schedule 4 is the standard vaccination schedule for children born after 1 July 2013 who turns 1 in the relevant income year under which a child must be vaccinated against a disease or antigen mentioned in an item at the age mentioned in that item.

(3)   Subject to subsections (5) to (7), the standard vaccination schedules for children born before 1 July 2012 are as follows:

(a)for children who turn 2 in the relevant income year – Schedule 2;

(b)for children who turn 5 in the relevant income year – Schedule 3;

under which a child must be vaccinated against a disease or antigen mentioned in an item at the age mentioned in that item.

       (4)   Subject to subsections (3) to (5), the standard vaccination schedules for children born after 1 July 2012 are as follows:

(a)for children who turn 2 in the relevant income year – Schedule 5;

(b)for children who turn 5 in the relevant income year – Schedule 6;

under which a child must be vaccinated against a disease or antigen mentioned in an item at the age mentioned in that item.

(5)   A child is not taken to be overdue for a vaccination under the standard vaccination schedule until one month after the vaccination is due.

(6)   Subject to subsection (7), a vaccine used to vaccinate a child against an antigen or disease mentioned in Schedule 1 must be registered as a vaccine on the Australian Register of Therapeutic Goods.

(7)   Subsection (6) does not apply to a vaccine used to vaccinate a child while the child is outside Australia.

1. Catch up vaccination schedule

(1)   The catch up vaccination schedule for a child is as determined under Part 1.3.5 of the National Health and Medical Research Council Australian Immunisation Handbook volume 9, to the extent that it relates to the vaccinations against diseases or antigens listed in Schedules 1 to 6, and the relevant vaccine meets the requirements of subsection 5(6). The catch up vaccination schedule for a child is assessed as follows:

(a)for children who turn 1 in the relevant income year – after their first birthday;

(b)for children who turn 2 in the relevant income year – after their second birthday;

(c)for children who turn 5 in the relevant income year – after their fifth birthday.

(2)   A child is not taken to be overdue for a vaccination under their catch up vaccination schedule until one month after the vaccination is due.

Note 1:        It is not necessary for the medical practitioner to have administered the vaccine(s) to the child at the ages listed in second column of each standard vaccination schedule for the child to be considered to have been vaccinated in accordance with a catch up schedule.

Note 2:         It is intended that the timing of catch up vaccinations will be individual to the particular child after appropriate consideration by the medical practitioner of any diseases or antigens the child may already have been vaccinated against.

Schedule 1           Standard vaccination schedule for a child born before 1 July 2013 and who turns 1 in the relevant income year
