The Greater Sydney Commission makes the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Fairfield Local Environmental Plan 2013 (Amendment No 22).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to Lot 1, DP 781418, 620 Elizabeth Drive, Bonnyrigg Heights.

4      Maps

The maps adopted by Fairfield Local Environmental Plan 2013 are amended or replaced, as the case requires, by the maps approved by the Greater Sydney Commission on the making of this Plan.

5      Amendment of Fairfield Local Environmental Plan 2013

Schedule 1 Additional permitted uses

Insert after clause 19:

20      Use of certain land at 620 Elizabeth Drive, Bonnyrigg Heights

(1)

This clause applies to land identified as “22” on the Key Sites Map.

(2)

Development for the purposes of a service station and take away food and drink premises is permitted with development consent, but only if:

(a)

the consent authority is satisfied that the maximum gross floor

area of the site that is used for the purposes of a service station

and take away food and drink premises does not exceed 600m2,

excluding the floor space of a service station that comprises the

driveway, petrol pumps and pump islands, and

(b)

not more than 1 take away food and drink premises is located on the site at any one time.
