The Court rejected Food Republic's defence of genuine mistake, finding that the company had not taken reasonable steps to ensure compliance. The Court applied the principles of statutory interpretation to the relevant provisions of the Act and the award, emphasizing the employer's obligation to ensure correct payment of wages.

Consequently, the Court ordered Food Republic to pay pecuniary penalties totalling $10,800 for the contraventions. In addition, Food Republic was ordered to rectify the underpayments to the affected employees, with the total amount of back pay to be determined.
