Fair Trading (Fuel Price Board) Regulation 2017

Part 1    Preliminary

1   Short title

This regulation may be cited as the Fair Trading (Fuel Price Board) Regulation 2017.

2   Commencement

This regulation commences on 31 January 2018.

3   Definitions

The dictionary in schedule 1 defines particular words used in this regulation.

Part 2    Display of fuel prices on price boards

4   Discounted fuel price not to be displayed

(1)A fuel retailer must not display a discounted fuel price for a type of fuel on a price board.

Maximum penalty—20 penalty units.

(2)In this section—
discounted fuel price, for a type of fuel, means the price at which fuel of that type is available for retail sale after a discount is applied (whether because of a discount rate, reward scheme or voucher or in any other way).

5   Display of increase in normal fuel price

(1)This section applies if a fuel retailer increases the normal fuel price for a type of fuel supplied by the retailer for retail sale at a service station.
(2)The fuel retailer must change the normal fuel price displayed on each price board at the service station to reflect the increase before, or at the same time as, changing any fuel pump display for that type of fuel at the service station to reflect the increase.

Maximum penalty—20 penalty units.

6   Display of decrease in normal fuel price

(1)This section applies if a fuel retailer decreases the normal fuel price for a type of fuel supplied by the retailer for retail sale at a service station.
(2)The fuel retailer must change the normal fuel price displayed on each price board at the service station to reflect the decrease after, or at the same time as, changing any fuel pump display for that type of fuel at the service station to reflect the decrease.

Maximum penalty—20 penalty units.

Schedule 1 Dictionary

section 3

fuel means—
(a)fuel within the meaning of the Fuel Quality Standards Act 2000 (Cwlth); or
(b)hydrogen.
fuel pump display means the display of the normal fuel price for a type of fuel appearing on a metered fuel pump at a service station.
fuel retailer means a person who carries on the business of supplying fuel for retail sale.
normal fuel price, for a type of fuel, means the price at which fuel of that type is available for retail sale without any discount being applied in any way.
price board means a board, sign or notice that is visible to a person in a motor vehicle at, or passing by, a service station that displays information about the price of types of fuel for retail sale at the service station.
service station means a place where fuel is supplied for retail sale, other than a place where the primary business being conducted is the hiring, leasing or selling of motor vehicles.
