His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Fair Trading Act 1987.

Explanatory note
The object of this Regulation is to amend the Fair Trading Regulation 2007 to prescribe a product safety standard for magnetic toys. Magnets that are intended to be used in playing with magnetic toys perform various functions such as joining carriages of a toy train, holding letters, figures and objects to a metal board or playscene and attaching magnetic darts to dartboards.
The product safety standard for magnetic toys is that they must comply with the relevant provision in the Australian/New Zealand Standard entitled AS/NZS ISO 8124.1:2002, Safety of toys, Part 1: Safety aspects related to mechanical and physical properties (ISO 8124–1:2000, MOD).
This Regulation is made under the Fair Trading Act 1987, including sections 26 and 92 (the general regulation-making power).

2 Commencement
This Regulation commences on 1 March 2010 and is required to be published on the NSW legislation website.

50A Definitions
In this Division:
AS/NZS ISO 8124 means the Australian/New Zealand Standard
entitled AS/NZS ISO 8124.1:2002, Safety of toys, Part 1: Safety aspects
related to mechanical and physical properties (ISO 8124–1:2000,
MOD) as published jointly by Standards Australia and Standards New
Zealand and as in force on 20 February 2009.
hazardous magnet has the same meaning as in AS/NZS ISO 8124.
magnetic toy means a toy, being an object or group of objects
manufactured, designed, labelled or marketed as a plaything for a child
or children under the age of 14 years, that contains one or morehazardous magnets that are intended to be used in playing with the toy.
50B Safety standard
The product safety standard prescribed for magnetic toys is that they must comply with the requirements of clause 4.28 of AS/NZS ISO 8124.
