Explanatory note
The object of this Regulation is to amend the product information standards for fuel price signs to ensure
that the price of E10 is displayed at service stations at which it is supplied by retail and remove requirements
for the price of the top-selling fuel to be displayed if more than 4 types of prescribed fuel are supplied by

1      Name of Regulation

This Regulation is the Fair Trading Amendment (Fuel) Regulation 2016.

2      Commencement

This Regulation commences on the day on which Schedule 2 [1] of the Biofuels Amendment Act 2016 commences and is required to be published on the NSW legislation website.

Schedule 1 Amendment of Fair Trading Regulation 2012

[1]      Clause 9 Definitions

Omit the definitions of E10 petrol, normal price, petrol station and prescribed fuel.
Insert in alphabetical order:

biodiesel, biodiesel blend, diesel fuel, E10, ethanol, petrol and petrol-ethanol
blend have the same meanings as in the Biofuels Act 2007.
diesel means diesel fuel other than biodiesel blend.
prescribed fuel, service station, service station operator and standard retail
price have the same meanings as in section 58 of the Act.
type of prescribed fuel means a kind of prescribed fuel specified in an order
under section 58 of the Act.

[2]      Clauses 10, 11 and 12

Omit “petrol station” wherever occurring. Insert instead “service station”.

[3]      Clause 11 Product information standard

Omit “normal price” wherever occurring. Insert instead “standard retail price”.

[4]      Clause 11 (4)

Omit the subclause. Insert instead:

(4) If more than 4 types of prescribed fuel are supplied to retail customers at the
service station:
(a) the price of 4 types of prescribed fuel must be displayed as required by subclause (1), and
(b) the 4 types of prescribed fuel for which the price must be displayed must include such of the following types of prescribed fuel as are supplied to retail customers at the service station:

(i)      diesel,

(ii)      lpg,

(iii)      E10.

[5]      Clause 11 (6)

Omit the subclause.

[6]      Clause 12 Octane rating information

Omit “E10 petrol” from clause 12 (1) (a). Insert instead “E10”.
