Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fair Trading Act 1987.

Explanatory note
The object of this Regulation is to amend the Fair Trading Regulation 2007 to prescribe a product safety standard for bunk beds supplied as an item of furniture or as part of an item of furniture. The product safety standard for bunk beds is that they must comply with the relevant provisions in the Australian/New Zealand Standard entitled AS/NZS 4220:1994, Bunk beds.
This Regulation is made under the Fair Trading Act 1987, including sections 26 and 92 (the general regulation-making power).

This Regulation is the Fair Trading Amendment (Bunk Beds)
Regulation 2010.
2 Commencement
This Regulation commences on the day on which it is published on the
NSW legislation website.

Part 2, Division 17B
Insert after Division 17A of Part 2:
Division 17B Bunk beds
71D Definition In this Division:
AS/NZS 4220 means the Australian/New Zealand Standard
entitled AS/NZS 4220:1994, Bunk beds published jointly by
Standards Australia and Standards New Zealand on
29 August 1994.bunk bed means:
(a)
a set of components that are assembled or ready for assembly into single beds or a combination of a double and a single bed that are intended to be stacked one over the other, or
(b)
any single bed, other than a hospital bed, where the upper surface of the mattress base is at least 800 mm above the floor surface,
supplied as an item of furniture or part of an item of furniture, but
does not include a bed:
(c) designed for camping, or (d)
that is a built-in fitting in a caravan, camper trailer, tent trailer, camper van, motor home, train, ship, aircraft or other type of conveyance.
71E Safety standard The product safety standard prescribed for bunk beds is that they must comply with AS/NZS 4220.
71F Variation of AS/NZS 4220 For the purposes of this Division, AS/NZS 4220 is taken to have been amended as follows:
(a)
by omitting clauses 1, 2, 3.1, 4, 5, 6.1, 6.2, 6.5–6.7, 6.9, 7.1 (c), 7.2–7.10, 8 and 9 (b) (i) and (d),
(b)
by omitting “75” wherever occurring in paragraph (b) of clause 7.1 and Appendices A3 (a) (iv), A5 (e) and A6 (c) and by inserting instead “95”,

(c) by omitting “A distinct mark” from paragraph (c) of clause 9 and by inserting instead “For the upper bed, where the height of the guard rails is less than 360 mm above the mattress base—a distinct mark”, (d) by omitting Appendices A3 (b) and B–J, (e) by omitting from paragraph (a) of Appendix A5 the words “Place a mattress on each of the mattress bases of the bunk bed.”.
