FAIR TRADING ACT 1987—REGULATION

(Repeal of unnecessary product information standard relating to bedding and

upholstered furniture)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fair Trading Act 1987, has been pleased to make the Regulation set forth hereunder.

The Fair Trading (Product Information Standards) Regulation 1992 is amended by omitting Schedule 2.

EXPLANATORY NOTE

The object of this Regulation is to remove the product information standard to be

used for bedding and furniture upholstery contained in Schedule 2 to the Fair Trading (Product Information Standards) Regulation 1992. Currently, Schedule 2 requires bedding and upholstered furniture, and any bale, package or lot containing filling for such goods, to be marked with a statement as to the kind or kinds of filling used, the nature of the filling, the identity of the manufacturer, and whether the goods are second hand. The form of the statement of this information is also prescribed.

Schedule 2 is now considered unnecessary as the information required by the
standard is likely to be given voluntarily by industry, and any incorrect labelling can be
dealt with under Part 5 (in particular, sections 44 and 49) of the Fair Trading Act 1987.

This Regulation is made under the Fair Trading Act 1987, including section 92 (the general regulation-making power) and section 38 (Prescribing of product information standards).
