FAIR TRADING ACT 1987—REGULATION
(Relating to the product safety standard for sunglasses and fashion spectacles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fair Trading Act 1987, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 February 1994.
Amendments
2. The Product Safety Regulation 1988 is amended:
(a) by omitting from clause 21 the definition of “AS 1067—1983”;
(b)
byinsertinginthedefinitionof“AS1067.1—1990”inclause21 after the matter “ l 0 December 1990” the words “and Amendment No. 2 of 12 July 1993”;
(c)
byomitting from paragraph(a)ofthedefinitionof“sunglasses” and “fashion spectacles” in clause 21 the matter “clause 1.4.2.2. or 1.4.2.3. of AS 1067—1983” and by inserting instead the matter “clause 1.3.7.2 or 1.3.7.3 of AS 1067.1—1990”;
(d)
byomittingclause22(1)andbyinsertinginsteadthefollowing subclause:
(1) The product safety standard prescribed for sunglasses and
fashion spectacles is that they must comply with AS 1067.1—1994—No. 32
(e) by omitting clause 22 (2).
EXPLANATORY NOTE
At present, the product safety standard for sunglasses and fashion spectacles is that they comply with one of two Australian Standards (with certain modifications), the first entitled “Sunglasses and Fashion Spectacles—Non-prescription Types” (AS 1067—1983) or the second, revised Standard, entitled “Sunglasses and fashion spectacles Pan 1: Safety requirements” (AS 1067.1—1990).
The object of this Regulation is to make it necessary for sunglasses and spectacles to comply with the revised Australian Standard (with the same modifications), by removing the earlier Australian Standard (AS 1067—1983). This change makes the product safety standard consistent with the consumer product safety standard prescribed under the Trade Practices Act 1974 of the Commonwealth.
The Regulation also updates the reference to the revised Australian Standard (AS
1067.1—1990) to include an amendment made to that Standard in July 1993.
This Regulation is made under the Fair Trading Act 1987, including section 26 (Safety standards) and section 92 (the general regulation making power).
