FAIR TRADING ACT 1987—REGULATION

(Relating to the Caravan and Relocatable Home Park Industry Code of

Practice Regulation 1992)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fair Trading Act 1987, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 6 September 1993.

Amendment

2. The Caravan and Relocatable Home Park Industry Code of Practice in Schedule 1 to the Caravan and Relocatable Home Park Industry Code

of Practice Regulation 1992 is amended by omitting from the matter
under the heading “Management’s general obligations” in Part 3 of the
Code of Practice the following matter:

The Agreement must be in accordance with the standard form of agreement for landlords and tenants of movable dwellings or movable dwelling sites set out in Schedule 2 to the Residential Tenancies Regulation 1989.

and by inserting instead the following matter:

The Agreement must be in accordance with one of the two standard forms of agreement for landlords and tenants of movable dwellings or

movable dwelling sites set out in Schedule 2 and Schedule 2A to the Residential Tenancies Regulation 1989. The choice of form depends on

the length of the tenancy:

• If the Agreement creates a tenancy for a term of up to 3 years, the Agreement must be in accordance with the standard form set out in Schedule 2; or
• If the Agreement creates a tenancy for a term of 3 years or more, the Agreement must be in accordance with the standard

form set out in Schedule 2A.

EXPLANATORY NOTE

The Residential Tenancies Regulation 1989 prescribes standard forms of residential tenancy agreement, including a standard form of agreement for landlords and tenants of movable dwellings or movable dwelling sites (Schedule 2). That Regulation is to be amended to provide a further standard form of residential tenancy agreement for such landlords and tenant which is suitable for registration under the Real Property Act 1900 (Schedule 2A).

The object of this Regulation is to amend the Code of Practice prescribed by the Caravan and Relocatable Home Park Industry Code of Practice Regulation 1992 as a consequence of the amendment of the Residential Tenancies Regulation 1989. The amended Code of Practice will refer to the registrable standard form of residential tenancy agreement in Schedule 2A to that Regulation (in addition to the current reference to the form in Schedule 2).
