FAIR TRADING ACT 1987—REGULATION
(Repeal of unnecessary product information standards relating to millet brooms
and toys made outside Australia)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fair Trading Act 1987, has been pleased to make the Regulation set forth hereunder.

The Fair Trading (Product Information Standards) Regulation 1992 is
amended by omitting Schedules 3 and 5.
EXPLANATORY NOTE
The object of this Regulation is to repeal Schedules 3 and 5 to the Fair Trading
(Product Information Standards) Regulation 1992.
Schedule 3 currently requires millet brooms to be marked with a statement indicating the proportion by weight of millet fibre to the total amount of millet fibre and other sweeping material contained in the broom and also provides for the form in which the information is to be stated. The Schedule is unnecessary as any incorrect labelling can be appropriately dealt with under Part 5 (in particular, sections 44 and 49) of the Fair Trading Act 1987.

Schedule 5 currently requires toys made outside Australia to be marked with a statement indicating the name of the country in which the toys were made. The statement must be in English and be attached to each toy in a conspicuous position. This Schedule is also unnecessary as Part II (in particular, regulations 8 and 9 ) of the Commerce (Imports) Regulations of the Commonwealth also has similar requirements which are enforced by the Australian Customs Service.
This Regulation is made under the Fair Trading Act 1987, including section 92 (the
general regulation-making power) and section 38.
