FAIR TRADING ACT 1987—REGULATION
(Relating to pedal bicycles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fair Trading Act 1987, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 3 March 1995.
Amendments
2. The Product Safety Regulation 1988 is mended:
(a) by omitting from clause 25 the definitions of “AS 1927–1978” and “AS 1927–1985” and by inserting inserting instead the following definition: “AS 1927–1989” means the Australian Standard entitled “Pedal bicycles for normal road use—Safety requirements” and numbered AS 1927–1989, of the Standards Association of Australia, as in force on 19 May 1989;
| (b) | by omitting from clause 26 (1) the words “they shall conform to AS 1927–1978 or AS 1927–1985” and by inserting instead the words “they must conform to AS 1927–1989”; |
| (c) | by omitting clause 26 (2) and (3) and by inserting instead the following subclause: |
(2) For the purposes of subclause (l), AS 1927–1989 is to be
treated as having been amended as follows:

(12.5 (a) by omitting from clauses 1.1, 2.1, 3.1 and 4.1 the word “sale” wherever occuring and by inserting instead the word “supply”; (b) by omitting clause 1.2;
(c) by omitting clause 1.5 (a) and by inserting instead the following paragraph:
(a)
The registered name and address of the Australian manufacturer or assembler or the registered name and address of the Australian distributor of the pedal bicycle.
(d)
by omitting from clause 2.14.2.8 the word “provided” and by inserting instead the word “fitted”.
EXPLANATORY NOTE
The object of this Regulation is to revise the product safety standard for pedal bicycles to accord with the Consumer Product Safety Standard for pedal bicycles introduced by the Commonwealth on 8 December 1994. The Commonwealth Standard adopts (with certain variations) the Australian Standard entitled “Pedal bicycles for normal road use–Safety requirements” and numbered AS 1927–1989.
This Regulation is made under the Fair Trading 1987, including section 26 (safety
standards) and section 92 (the general regulation making power).
