1990 - NO. 746
FAIR TRADING ACT 1987 - REGULATION
(Relating to the product safety standard for elastic luggage straps)
NEW SOUTH WALES
[Published in Gazette No. 154 of 30 November 1990]
HIS Excellency the Governor, with the advice of the Executive
Council, and in pursuance of the Fair Trading Act 1987, has been pleased to make the Regulation set forth hereunder.
G. B. PEACOCKE
Minister for Business and Consumer Affairs.
The Product Safety Regulation 1988 is amended by inserting after the heading to Part 21 the following clause:
Application of Part
52A. This Part has no effect on and from the commencement of
this clause until 1 March 1991.
EXPLANATORY NOTE
Part 21 of the Product Safety Regulation 1988 commenced on 27 July 1990.
The Part prescribes a safety standard for elastic luggage straps and complements
the provisions of the Trade Practices (Consumer Product Safety Standards) Regulations of the Commonwealth. The Commonwealth has allowed a moratorium period until 1 March 1991 for compliance with those provisions. The object of this Regulation is to allow a similar period in NSW. While suppliers need not comply with Part 21 from the commencement of the proposed Regulation until 1 March 1991 the effect of that Part between 27 July 1990 and that commencement will be preserved by section 30 of the Interpretation Act 1987.
