Restraints) Regulation 1999

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fair Trading Act 1987.

Explanatory note

Schedule 11 to the Fair Trading (Product Safety Standards) Regulation 1995 sets out product safety standards in relation to child restraints. The product safety standard prescribed for child restraints up to and including 31 December 1995 was that they had to comply with AS 1754—1975 or AS 1754—1991. Child restraints after 31 December 1995 must comply with AS 1754—1991.

The object of this Regulation is to prescribe as the product safety standard for components of child restraints that they must comply with AS 1754—1975 or AS 1754—1991.

This Regulation is made under the Fair Trading Act 1987, including sections 26

(Safety standards) and 92 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Fair Trading (Product Safety Standards)
Amendment (Child Restraints) Regulation 1999.

2 Amendment of Fair Trading (Product Safety Standards) Regulation 1995

The Fair Trading (Product Safety Standards) Regulation 1995 is amended as set out in Schedule 1.

Omit clause 2 (1).

[2]      Schedule 11, clause 2 (3)

Insert after clause 2 (2):

(3) Despite subclause (2), the product safety standard for:

(a)

a component of a child restraint that is designed to restrain a child in a safety device, and

(b)

a component of a child restraint that anchors a child safety device to a motor vehicle, and

(c) a component to restrain a motor vehicle seat, and
(d) any other component of a child restraint,
is that they must comply with AS 1754—1975 or AS
1754—1991.
