FAIR TRADING ACT 1987—REGULATION
(Fair Trading (Penalty Notices) Regulation 1993)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Fair Trading Act 1987, has been pleased to make the Regulation set forth hereunder.

Citation
1. This Regulation may be cited as the Fair Trading (Penalty Notices)
Regulation 1993.
Commencement
2. This Regulation commences on 12th March, 1993.
Definition
3. In this Regulation:
“the Act” means the Fair Trading Act 1987.
Prescribed offences and penalties
4. For the purposes of section 64 of the Act:
(a) an offence specified in Schedule 1 is a prescribed offence; and
| (b) | the amount specified in Schedule 1 in respect of such an offence is |
the prescribed amount of penalty for the offence.

OFFENCE PENALTY
Offences under the Fair Trading Act 1987
Section 32 (2)—supply goods in contravention of an interim order or permanent order in force under
section 30 or 31 of the Act............................................ $500.00
Section 40 (1)—being a supplier, sell goods showing more than one price at a price greater than the lower or lowest price ............................................................. $200.00

SCHEDULE 1—PENALTY NOTICES
EXPLANATORY NOTE
The purpose of this Regulation is to prescribe certain offences under the Fair Trading Act 1987 as offences for which penalty notices may be issued and to prescribe the amount of the penalty payable under a penalty notice. This Regulation comprises matter of a machinery nature.
