Regulation 1999

Fair Trading Act 1987

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fair Trading Act 1987.

Explanatory note
The objects of this Regulation are:

(a) to prescribe the offence under section 39 (1) of the Fair Trading Act 1987 (failing to comply with product information standards) in relation to the supply of regular unleaded petrol as an offence that may be dealt with by way of penalty notice, and
(b) to specify the short description to be used in connection with that offence for the purposes of section 145B of the Justices Act 1902, and
(c) to specify the penalty payable for that offence when dealt with by way of penalty notice,
(d) to amend the Schedule to the Fair Trading (Penalty Notices) Regulation 1998 to include the Infringement Processing Bureau codes that relate to the offences listed in that Schedule.

This Regulation is made under the Fair Trading Act 1987, including sections 64 and 92 (the general regulation-making power) and section 145B of the Justices Act 1902.

1      Name of Regulation

This Regulation is the Fair Trading (Penalty Notices) Amendment

(Petrol Prices) Regulation 1999.

2 Commencement

This Regulation commences on 24 March 2000.

3 Amendment of Fair Trading (Penalty Notices) Regulation 1998

The Fair Trading (Penalty Notices) Regulation 1998 is amended as set out in Schedule 1.

(Clause 3)

[1]      Clause 3 Definitions

Insert in clause 3 in alphabetical order:

Infringement Processing Bureau means the Infringement
Processing Bureau within the Police Service.
IPB Code, in relation to an offence, means the code
allocated to the offence by the Infringement Processing
Bureau.

[2]      Clause 6 Short descriptions

Omit clause 6 (1) (a) and (b). Insert instead:

(a)

if one or more IPB codes are set out in relation to the offence in Column 4 of Schedule 1, any of those IPB codes together with:

(i)

the text set out in relation to the offence in Column 2 of Schedule 1, or

(ii)

if a choice of words is indicated in that text, the words remaining after the omission of the words irrelevant to the offence, or

(b)

if no IPB code is set out in relation to the offence in Column 1 of Schedule 1:

(i)

the text set out in relation to the offence in Column 2 of Schedule 1, or

(ii)

if a choice of words is indicated in that text, the words remaining after the omission of the words irrelevant to the offence.
