FACTORIES, SHOPS AND INDUSTRIES

(AMENDMENT) ACT.

Act No. 58, 1964.

An Act to make further provisions relating to the closing times of hairdressers' shops ; for this purpose to amend the Factories, Shops and Industries Act, 1962 ; and for purposes connected therewith. [Assented to, 16th December, 1964.]

BE it enacted by the Queen ' s M o s t Excellent Majesty, by

a n d with the advice and consent of the Legislative
Counci l and Legislative Assembly of New South Wales in

Par l iament assembled, and b y the author i ty of the same, a s

fo l lows : 
1. ( 1 ) This A c t m a y b e ci ted as the "Fac to r ies , Shops
and Indust r ies ( A m e n d m e n t ) Ac t , 1 9 6 4 " .
( 2 ) T h e Fac tor ies , Shops a n d Indust r ies Ac t , 1 9 6 2 ,
as a m e n d e d b y this Ac t , m a y b e cited as the Fac tor ies , Shops
a n d Industr ies Ac t , 1 9 6 2 - 1 9 6 4 .
2. T h e Fac tor ies , Shops and Industr ies Ac t , 1 9 6 2 , is

a m e n d e d —

(a ) b y inser t ing in sect ion seventy-eight immedia te ly
before the definition of " O c c u p i e r " the following

new definitions : —

"Hai rdresser ' s s h o p " m e a n s shop in which the
( i i )

business of a hai rdresser is car r ied o n .

" L a d i e s ' hai rdress ing s h o p " m e a n s hai rdresser ' s

shop in which hairdress ing work is d o n e for

females only.

" M e n ' s hai rdress ing s h o p " m e a n s hai rdresser ' s
shop o the r t han a ladies ' hai rdress ing shop .
(b ) ( i) by omit t ing f rom subsect ion th ree of sect ion

seventy-nine the w o r d "ha i rdressers ' " wher­ ever occur r ing a n d by insert ing in lieu thereof

the words "men ' s ha i rd re s s ing" ;

(ii)    by inserting at the end of the same subsection

the following new p a r a g r a p h : —
(b ) T h e open ing a n d closing t imes for

lad ies ' hai rdress ing shops si tuate in any area , whether or no t employees a re employed in such shops, shall o n each week day b e such t imes as m a y be fixed by any State award for the t ime being in force for the c o m m e n c e m e n t and cessat ion, respectively, of the o rd inary hou r s of work by employees in such shops in such a rea : P rov ided tha t on all days appo in ted by such a n award t o b e hol idays for such employees in any a rea all ladies ' hai rdress ing shops in tha t a rea shall be kep t closed.

( c ) by omit t ing from section eighty-five the words " w o r k o n week days by employees in shops (o ther t h a n scheduled shops a n d shops for the sale of mo to r vehicles, m o t o r spirit, m o t o r oil o r m o t o r acces­ sories) in any a rea shall no t b e later t han six o 'c lock in the af ternoon, a n d " a n d by insert ing in lieu
thereof the words " w o r k —

(i)    on week days by employees in shops (other t han scheduled shops, ladies ' hairdress ing shops a n d shops for t h e sale of m o t o r vehicles, m o t o r spirit, m o t o r oil o r m o t o r accessories) in any area , a n d on week days o ther t han Thur sdays by employees in lad ies ' hairdress ing shops in any area , shall no t be

later t han six o 'c lock in the a f t e rnoon;
(ii)
on Thursdays by employees in ladies' hair­ dressing shops in any area shall no t b e la ter t han forty-five minutes after the h o u r of

eight o 'clock in the af ternoon,

a n d " .
