FACTORIES, SHOPS AND INDUSTRIES ACT 1962—

REGULATION

(Relating to welders’ and welding supervisors’ certificates)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Factories, Shops and Industries Act 1962, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1st December, 1992.

Amendments

2. The Boiler and Pressure Vessel Regulations are amended:

(a)

by omitting from Regulation 72 (I1, (2), (3), (4) and (5) the words “Chief Inspector” wherever occurring and by inserting instead the word “Authority”;

(b)

by omitting Regulation 72 (2) (a) and by inserting instead the following paragraph:

(a)

be in the form approved by the Authority and contain such particulars, and be accompanied by such documents, as that form requires;

(c)

by omitting from Regulation 72 (3) the words “in or to the effect of Form B.R. 12”;

(d)

by omitting from Regulation 72 (4) the words “in or to the effect of Form B.R. 13”;

(e) by inserting after Regulation 72 (4) the following clause:

(4A) A certificate issued under this Regulation is to be in the form approved by the Authority and, in the case of a welder’s certificate, is to include a photograph of the holder of the certificate.

(f) by omitting Forms B.R.11–B.R.13 from Schedule 2.

EXPLANATORY NOTE

The purpose of this Regulation is to amend the Boiler and Pressure Vessel

Regulations so as:

(a)

to provide for the Workcover Authority (in place of the Chief Inspector of Boilers):

• to issue welders’ and welding supervisors’ certificates; and

to approve other authorities who may issue any such certificates acceptable to the Authority; and

• to approve the form of certificate issued; and

(b) to provide for a welder’s certificate to include the certificate holder’s photograph; and
(c) to repeal the prescribed forms for a welder’s certificate, a welding
