REGULATION

(Relating to the concentration of airborne asbestos fibres i n air in factories)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Factories, Shops and Industries Act 1962, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 2 September 1996.

Amendment

2. The Factories (Health and Safety—Asbestos Processes) Regulation 1984 is amended by omitting from paragraph (a) of the definition of “excess asbestos dust” in clause 4 (1) the matter “1.0” and by inserting instead the matter “0.5”.

EXPLANATORY NOTE
The Factories (Health and Safety—Asbestos Processes) Regulation 1984 requires

exhaust equipment to be provided in-any factory in which an asbestos process is carried out. That exhaust equipment must be such, and must be so operated, as will prevent excess abestos dust from being present in the breathing air of any employee in the factory. In addition, an employee in any area of work in which excess asbestos dust is or is liable to be present in the employees’ breathing air is entitled to be provided with protective clothing and approved respiratory protective equipment.

This Regulation amends the Factories (Health and Safety-Asbestos Processes) Regulation 1984 to reduce the concentration of certain airborne asbestos fibres required in air before excess asbestos dust is regarded as existing in a factory.

This Regulation is made under the Factories, Shops and Industries Act 1962,

including section 144 (the general regulation making power).
