REGULATION
(Relating to fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Factories, Shops and Industries Act 1962, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 21 June 1991.
Amendments
2. The Boiler and Pressure Vessel Regulations are amended:
(a) by omitting from Regulation 20 the words “accompanied by the
prescribed fee ”; (b) by omitting from Regulation 20 the words “of this Regulation”; (c) by inserting at the end of Regulation 20 the following clauses:
(2) After the documents required to be furnished by this Regulation have been received by the Chief Inspector, the Chief Inspector is to send to the manufacturer concerned a statement of the fee payable under this Regulation
(3) The fee payable under this Regulation is to be calculated:
1991—No. 263
(a) at $70 in any case where the documents have been accompanied by a letter or certificate of compliance from a design reviewer and the Chief Inspector is satisfied that the letter or certificate contains evidence of a review sufficiently detailed, expert and impartial for the purposes of these Regulations; or (b) in any case—at $85 for each hour or part of an hour which the Chief Inspector or a design reviewer employed or engaged by or for the Chief Inspector must spend reviewing the documents for the purposes of these
Regulations
(4) The manufacturer concerned is to forward to the Chief Inspector the fee stated under clause (2) within 14 days of the receipt of the statement.
(d) by omitting paragraph 2 of Schedule 1.
EXPLANATORY NOTE
The object of this Regulation is to prescribe a new basis for fees for the examination of certain designs of boilers and pressure vessels by the Chief Inspector. At present, fees are based on various dimensions of boilers and pressure vessels.
The new fee will be charged either at an hourly rate or, where the designs are submitted to the Chief Inspector together with an independent reviewer’s report, at a (reduced) flat rate.
