Factories (Health and Safety—Spray New South Wales

Painting) Amendment Regulation 1999

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Factories, Shops and Industries Act 1962.

Explanatory note
The object of this Regulation is:

(a) to remove the requirement for the design, construction and location of spray painting booths to be approved by the Chief Inspector and to require instead that the adequacy of those matters be assessed by the occupier of a factory to ensure that the health and safety of persons who work in or near, or who are required to be in or near, spray painting booths is protected, and
(b) to remove requirements for other aspects of spray painting work in booths to be approved by the Chief Inspector.

This Regulation is made under the Factories, Shops and Industries Act 1962, including section 68 (the general regulation-making power).

Amendment Regulation 1999.

2 Commencement

This Regulation commences on 8 December 1999.

3 Amendment of Factories (Health and Safety—Spray Painting)

Regulation 1977

The Factories (Health and Safety—Spray Painting) Regulation 1977 is amended as set out in Schedule 1.

(Clause 3)

[1]     Clause 8 Spray painting to be done in booths

Insert after clause 8 (1):

(1A) Before a booth is erected, or used, for spray painting in a factory, the occupier of the factory must make an assessment of the adequacy of the design, construction and location of the booth to ensure the protection of the health and safety of persons who work in or near, or are required to be in or near, the booth.

[2]     Clause 9 Requirements for booths

Omit clause 9 (1)–(3). Insert instead:

(1) Subject to this Regulation, no booth is to be erected, or used, for spray painting in a factory unless the provisions of subclauses (4)–(12) inclusive are complied with in respect of the booth.

[3]     Clause 9 (4)

Omit “or of an approved type”.

[4]     Clause 9 (5)

Omit “an approved”. Insert instead “a”.

Omit “an approved material”.
Insert instead “some other appropriate material”.
