The following amendments are made in section Amendment four of the Principal Act :_ of s. 4. In the definition of "Bakehouse," after the word " Cookshop" .the words "or hotel" are inserted. In the definition of "Employee," after the words " When used with respect to shops" the words " the term includes persons engaged in clerical work, but does not include persons engaged solely as carters or" are repealed and the words" the term does not include persons engaged" are inserted in lieu thereof. The definition of "Nigh t" is repealed. 3. In the second paragraph of section seven of the Amendment Principal Act, before the words "Every occupier" the of s. 7. words "Except as herein otherwise provided" are inserted. . * 64 Vic. Any person who at any time is in. occupation of any factory or shop which is not registered shall be liable to a. penalty not exceeding five pounds. Any occupier of any registered factory or shop who fails to renew the registration of such factory or shop on or before the thirty-first day of January in each year shall be liable to a penalty not exceeding five pounds. Amendment 4. The following subsection is added to section of 8.27. twenty-seven of the Principal Act :- (19.) .+he provisions of this section shall apply to every wharf and every building and structure thereon, subject, however, to such alteration or modification with respect to any of the matters provided for in this section' as the Governor in Council, by Order in Council published in the Gazette, may from time to time direct and declare. Any such Order in Council may be general in its application or may be confined to the wharves in any particular district or to any particular wharf, and the provisions of this section as so altered or modified shall be applicable as is by the Order, in Council provided. For the purpose of the application to any wharf of the provisions of this section as altered or modified, any such Order in Council may declare what person shall be deemed to be the occupier of a wharf, and what person or class of persons shall be deemed to be employees. Subsections one to nine, both inclusive, of section of s. 52. fifty-two of the PrincIpal Act are repealed. In subsection ten of the said section, the words "The provisions of this section shall not apply to butchers or photographers, and the persons carrying on ei,her of those businesses within the district" are repealed,· and the words "The persons carrying on the business of butcLers or the business of photographers within any Police District" are inserted in lieu thereof; also, all words from and inclusive. of the words "The provisions of the first :qine subsections" to the end of the section are repealed. After the said first paragraph the following provision is inserted :- It shall not be lawful for any occupier of any factory or shop to cart or deliver, or permit any person in his employment to cart or deliver, any goods, wares, mer- chandise~ ..or materials whatsoever on such half-holiday: Provided also that, where an industrial award or agreement under *" The Industrial Arbitration Act 0/ 1916" prescribes a weekly whole holiday for carters, the last preceding paragraph hereof shall apply with respect to the whole of such weekly holiday. The proviso to the said section contained in the last paragraph thereof is repealed. , 8. The following amendments are made in section Amendment 56A of the Principal Act:- of s. 56A.. Jp the first paragraph the words "fifty-three" are repealed and the words "forty-eight" are inserted in lieu thereof. The second proviso is repealed and the following provisions are inserted in lieu thereof :- Provided also that it shall not be unlawful for any such carter to work overtime in excess of the maximum number of ordinary working hours prescribed herein, but such overtime may not be worked after one o'clock in the afternoon on the day of the weekly half-holiday nor before or after the prescribed starting or ceasing time provided for in any industrial award or agreem~ t under *" The Industrial Arbitration Act 0/ 1916": Provided also that, if an industrial award or agree- ment under *" The Industrial Arbitration Act 0/ 1916 " prescribes a starting time and a ceasing time for employees; it shall not be lawful for any occupier of any factory or shop to cart or ~ eliver or permit any person in his employment to cart or deliver any goods, wares, merchandise, or materials whatsoever before such starting time or after such ceasing time: Provided also that it shall not be lawful for any occupier of any factory or shop to cart or deliver, or permit * 7 Geo. No. 7, any person in his employment to cart or deliver, on Sun- days, any goods, wares, merchandise, or materials whatso- ever with the exception of milk and ice-cream: Provided, however, that under any extraordinary cITcumstances the chief inspector shall have power to grant such exemption from the operation of this section as he deems expedient. In the last paragraph, after the word "shop" the wor~s "and any person engaged in carrying on the business of parcel delivery in connection with any factory or shop, whether he employs any carters or not, shall be deemed to be th~ occupier of a parcel delivery establi,shment," are inserted. . Repeal of s.58B. 9. Section 58B of the Principal Act is repealed. 10. After section fifty-nine of the Principal Act the following section is inserted:- Industrial [59A.] The provisions of any industrial award or awards, ~ o., agreement under *" The Industrial Arbitration Act of to prevaJl. 1916" shall prevail over anything contained in this Act where any inconsistency exists between such award or agreement and this Act.
