REGULATIONS UNDER THE CUSTOMS ACT 1901 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905.*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901 and the Commerce (Trade Descriptions) Act 1905.

Amendments of the Exports (Meat) Regulations

Trade description.

1. Regulation 16 of the Exports (Meat) Regulations is amended—

(a) by inserting after sub-regulation (3) the following sub-regulation:—

“ (3a) The trade description of boneless meat intended for export shall, in the case of a principal label, be written on the label or, in the case of a brand, be written on the coverings in which the meat is contained.”;

(b) by inserting in sub-regulation (4) after the words “ description of ” the word “ bone-in ”;

(c) by inserting in sub-regulation (5) after the words “ package of ” the word “ bone-in ”; and

(d) by inserting in sub-regulation (5a) after the words “ description of ” the word “ bone-in ”.

Inspection of meat.

2. Regulation 33 of the Exports (Meat) Regulations is amended—

(a) by inserting in paragraph (c) of sub-regulation (5) after the word “ quality ” the word “ bone-in ”;

(b) by inserting in paragraph (d) of sub-regulation (5) after the word “ quality ” the word “ bone-in ”;

(c) by inserting in paragraph (e) of sub-regulation (5) after the word “ quality” the word “ bone-in ”; and

(d) by inserting in sub-regulation (6) after the words “ package of ” the word “ bone-in ”.

Improper use of inspection stamp.

3. After regulation 33 of the Exports (Meat) Regulations the following regulation is inserted:—

“ 33a. A person shall not use or apply an inspection stamp of the kind referred to in sub-regulation 33 (4) otherwise than in accordance with and for the purposes of regulation 33.

Penalty: $100.”.

Third Schedule.

4. (1) Item 26 in the Third Schedule to the Exports (Meat) Regulations is amended by inserting in the Second Column, after paragraph I, the following paragraph:—

“ 2. A piece of piece-beef shall consist of a piece recognized in commerce as a cut of piece-beef, and may be either bone-in or boneless ”.

(2) Item 26 in the Third Schedule to the Exports (Meat) Regulations is amended by omitting from paragraph 2 in the Third Column the words “ piece-beef other than first quality or second quality ” and substituting the words “ bone-in piece-beef other than first quality, second quality or third quality bone-in ”.

(3) Item 27 in the Third Schedule to the Exports (Meat) Regulations is amended by omitting paragraphs 3 and 4 from the Third Column.

(4) The Third Schedule to the Exports (Meat) Regulations is amended by inserting after item 43 the following items:—

“ 43a. Young sheep —first quality carcasses

1. A carcass shall be the carcass of—

1. The trade description shall include the words ‘ young sheep ’ on the tags and on the coverings

(a) a castrated male sheep; or

(b) a female sheep, which had not cut more than four permanent incisor teeth

2. A carcass shall be of good conformation and attractive appearance and have well-developed legs, loins and shoulders

3. A carcass shall exhibit good bloom

4. A carcass shall have an external covering of fat extending evenly over the legs, loins, back and shoulders

5. A carcass shall have an internal covering of fat on the loins and kidneys that is well, but not excessively, developed

“ 43b. Young sheep —second quality carcasses

1. A carcass shall be the carcass of—

1. The trade description shall include the words ‘ young sheep ’ on the tags and on the coverings

(a) a castrated male sheep; or

(b) a female sheep, which had not cut more than four permanent incisor teeth

2. A carcass shall be of reasonably good conformation and appearance and have reasonably well-developed legs, loins and shoulders

3. A carcass shall exhibit good bloom

4. A carcass shall have an external covering of fat extending over the legs, loins, back and shoulders but not necessarily so as to cover all the underlying muscle

5. A carcass shall have an internal covering of fat on the loins and kidneys that is firm in texture

“ 43c. Young sheep —third quality carcasses

1. A carcass shall be the carcass of—

1. The trade description shall include the words ‘ young sheep ’ on the tags and on the coverings ”.

(a) a castrated male sheep; or

(b) a female sheep, which had not cut more than four permanent incisor teeth

2. A carcass shall have such an external covering of fat as will reasonably protect the underlying muscle

3. A carcass shall have an internal covering of fat on the loins and kidneys that is firm in texture

(5) Item 60 in the Third Schedule to the Exports (Meat) Regulations is amended by omitting paragraphs 2 and 3 from the Third Column.
