Exports (Meat) Regulations2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Customs Act 1901 and the Commerce (Trade Descriptions) Act 1905.

Fees for officers’ services

Regulation 50 of the Exports (Meat) Regulations is amended—

  • (a)

    by omitting from sub-regulation (1) “of this regulation”;

  • (b)

    by omitting from sub-paragraph (1) (a) (i) “hours” and substituting “hour”;

  • (c)

    by omitting from sub-paragraph (1) (a) (ii) “Saturday, Sunday or holiday” and substituting “Saturday or Sunday”;

  • (d)

    by omitting from paragraph (1) (a) “$2.90” and substituting “$4.55”;

  • (e)

    by inserting after paragraph (1) (a) the following paragraph:

    • “(aa)

      in respect of services rendered on a holiday — a fee of $5.70 for each quarter-hour or part of a quarter-hour during which the services are so rendered;”;

  • (f)

    by omitting from paragraph (1) (b) “$2.20” and substituting “$3.40”;

  • (g)

    by omitting from paragraph (1) (c) “$2.20” and substituting “$3.40”;

  • (h)

    by omitting sub-regulations (1A), (1B) and (1C) and substituting the following sub-regulations:

  • “(1A)

    Sub-regulation (1) applies in relation to the services of an officer other than services of the kind referred to in sub-regulation (1B) or (1C).

  • “(1B)

    Subject to sub-regulation (3), where, at the request of a person, the services of an officer are made available to the person for the purposes of these Regulations and the officer renders services for a period of not more than 8 hours, being a period—

  • (a)

    that commences before the hour of 7 o’clock in the morning or concludes after the hour of 5 o’clock in the afternoon; and

  • (b)

    during the whole or part of which the officer performs shift-work,

the person shall be charged—

  • (c)

    in respect of services rendered on a week day — a fee of 35 cents for each quarter-hour or part of a quarter-hour during which the services are so rendered;

  • (d)

    in respect of services rendered on a Saturday — a fee of $3.40 for each quarter-hour or part of a quarter-hour during which the services are so rendered;

  • (e)

    in respect of services rendered on a Sunday — a fee of $4.55 for each quarter-hour or part of a quarter-hour during which the services are so rendered; and

  • (f)

    in respect of services rendered on a holiday — a fee of $5.70 for each quarter-hour or part of a quarter-hour during which the services are so rendered.

  • “(1C)

    Subject to sub-regulation (3), where, at the request of a person, the services of an officer are made available to the person for the purposes of these Regulations and the officer—

  • (a)

    renders services for a period of 8 hours, being a period during the whole or part of which the officer performs shift-work; and

  • (b)

    continues, with or without a meal break, to render services,

the person shall be charged, in relation to the services of the officer that are rendered outside that period of 8 hours, a fee of $3.40 for each quarter-hour or part of a quarter‑hour during which the services are so rendered.”;

  • (j)

    by omitting “-1960” from the definition of “holiday” in sub-regulation (4); and

  • (k)

    by omitting “-1960” from the definition of “officer” in sub-regulation (4).
