REGULATIONS UNDER THE CUSTOMS ACT 1901 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 19051

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901 and the Commerce (Trade Descriptions) Act 1905.

AMENDMENTS OF THE EXPORTS (GENERAL) REGULATIONS2

Application

1. Regulation 5 of the Exports (General) Regulations is amended—

(a) by omitting from paragraph (b) “not exceeding three pounds” and substituting “the mass of which does not exceed 1.5 kilograms”;

(b) by omitting from paragraph (c) “weight” and substituting “mass”;

(c) by omitting from sub-paragraph (i) of paragraph (c) “four ounces” and substituting “125 grams”; and

(d) by omitting from sub-paragraph (ii) of paragraph (c) “one ounce” and substituting “50 grams”.

Requirements as to trade description

2. Regulation 10 of the Exports (General) Regulations is amended by omitting from paragraph (e) of sub-regulation (1) “weight” and substituting “mass”.

Second Schedule

3. (1) The Second Schedule to the Exports (General) Regulations is amended as set out in the Schedule.

 

(2) In the Schedule—

(a) a reference by number to the name or description of goods shall be taken as a reference to the name or description of goods given that number in the first column of the Second Schedule;

(b) a reference to conditions and restrictions shall be taken as a reference to the conditions and restrictions in the second column of the Second Schedule; and

(c) a reference to provisions relating to trade descriptions shall be taken as a reference to the provisions in the third column of the Second Schedule.

(3) In respect of a reference by number to the name or description of goods referred to in column 1 of the Schedule—

(a) the conditions and restrictions applicable to those goods are amended as set out in column 2 opposite that reference; and

(b) the provisions relating to trade descriptions applicable to those goods are amended as set out in column 3 opposite that reference.

Third Schedule

4. The Third Schedule to the Exports (General) Regulations is amended by omitting from Form 1 “weight” and substituting “mass”.

Omit paragraph 13, substitute the following paragraph:

“13. If those cases are constructed of fibre board, they shall conform to Australian Standard Specification No. 1991 of 1978 as adopted by the Standards Association of Australia.”.

Omit paragraphs 18 and 19, substitute the following paragraph:

“18. Where fruit is packed in immediate containers made of tin plate, the mass of pulp in a container shall not exceed 15 kilograms and the mass of pulp in a case in which the containers are packed shall not exceed 30 kilograms, unless the fruit pulp is loaded into a shipping container and properly stowed to avoid damage.”.
