REGULATION UNDER THE CUSTOMS ACT 1901-1968 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905-1966.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council hereby make the following Regulation under the Customs Act 1901-1968 and the Commerce (Trade Descriptions) Act 1905-1966.

Amendment of the Exports (Fresh Vegetables) Regulations

First Schedule—Item 8.

The First Schedule to the Exports (Fresh Vegetables) Regulations is amended by omitting item 8 and inserting in its stead the following item;—

“8. Potatoes ..

1.—(1.) The potatoes shall be—

1.—(1.) The trade description shall include the words ‘Number 1 Grade Small’, ‘Number 1 Grade’ or ‘Number 1 Grade Commercial’, whichever is applicable.

(a) similar in colour, shape and general appearance;

(b)bright, firm, dry, mature and well shaped;

(c)free from wet and soft rots and other diseases;

(2.) The requirements of the last preceding sub-paragraph shall be deemed to be complied with if the abbreviation ‘No.’ is used in lieu of the word ‘Number’ in the trade description.”.

(d)free from injury, shrivelling, greening, growth cracks, sprouting and second growth and not dumb-bell shaped or excessively elongated; and

(e) reasonably free from adhering soil and other foreign matter,

(2.) For the purposes of the last preceding sub-paragraph ‘mature’ means that the skin does not loosen or feather readily during ordinary methods of handling.

2. The potatoes shall be packed—

(a) in crates; or

(b)in special circumstances and with the permission of the Secretary—in bags.

3. The potatoes shall be of one of the following sizes:—

‘Number I Grade Small’—not less than one ounce and not more than three ounces in weight;

‘Number 1 Grade’—more than three ounces and not more than sixteen ounces in weight.

4. Notwithstanding the provisions of paragraph 3, potatoes shipped to New Zealand in a container marked ‘Number 1 Grade Commercial’ or ‘No. J Grade Commercial’ may be ungraded for size if they are not less than two ounces in weight and not more than sixteen ounces in weight.
