REGULATIONS UNDER THE CUSTOMS ACT 1901–1971 AND THE COMMERCE (TRADE DESCRIPTIONS) ACT 1905–1966.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901–1971 and the Commerce (Trade Descriptions) Act 1905–1966.

Amendments of the Exports (Fresh Fruit) Regulations 

Analysis.

1. Regulation 29 of the Exports (Fresh Fruit) Regulations is amended by omitting sub-regulations (2.) and (3.) and inserting in their stead the following sub-regulation:—

“(2.) An officer of the Department of Customs and Excise for the time being occupying—

(a)the office of Assistant Comptroller-General (being the office of that designation in the Laboratory Branch) in that Department; or

(b) an office in that Department the designation of which includes the Word ‘chemist’,

shall be deemed to have been appointed to be an analyst under the last preceding sub-regulation.”.

Certificates of analysis.

2. Regulation 30 of the Exports (Fresh Fruit) Regulations is amended by omitting from paragraph (a)the words “by writing under the hand of an analyst” and inserting in their stead the words “under the hand of an analyst and”.

3.—(1.) Item 1 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting from the table in sub-paragraph (1.) of paragraph 1 (in the second column) the words—

“Red Delicious

/R.DEL./95/75”

and inserting in their stead the words—

“Red Delicious

/RED DEL./95/75”; and

(b)by inserting after sub-paragraph (3.) of paragraph 1 (in the second column) the following sub-paragraph:—

“(3a.) Where the Secretary has consented to the export of apples of a variety under the last preceding sub-paragraph, he may specify the abbreviation of the name of that variety that may be used as part of the trade description for the purposes of this item.”.

(2.) Item 1 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting the table in sub-paragraph (4.) of paragraph 1 (in the second column) and inserting in its stead the following table:—

(6.) Item 1 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting sub-paragraph (2.) of paragraph 4 (in the second column) and inserting in its stead the following sub-paragraph:—

“(2.) For the purposes of this paragraph, smooth and not unsightly russeting shall not be considered a blemish if—

(a)in the case of an apple of the Sturmer variety, not more than thirty per centum;

(b) in the case of an apple of the Cleopatra, Golden Delicious or Granny Smith varieties, not more than ten per centum; or

(c) in the case of an apple of any other variety, not more than twenty-five per centum,

of the surface of the apple is affected.”;

(b)by inserting after sub-paragraph (1b.) of paragraph 6 (in the second column) the following paragraph:—

“(1C.) Where apples, not being apples of a variety specified in the last preceding sub-paragraph, are intended for export to a port in Asia, other than a port that is situated on the Mediterranean Sea or the Red Sea, are packed in a fibreboard carton and are to be transported from the port of exportation to the port of destination on a ship that is to take more than seven days in so transporting the apples, the apples shall be packed as provided in the last preceding sub-paragraph.”; and

(c) by omitting from sub-paragraph (2.) of paragraph 6 the word “two” and inserting in its stead the word “three”.

Third Schedule— item 3.

4. Item 3 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by adding after paragraph 8 (in the second column) the following paragraph—

“9.—(1.) Grapefruits packed in a fibreboard carton shall, when stowed in a vessel otherwise than in a container system unit, be stowed in such a manner that at least one end or one long face of each carton is freely exposed to the cooling air.

“(2.) Grapefruits packed in a fibreboard carton shall, when stowed in a container system unit in a vessel, be stowed in such manner that at least one end of each carton is freely exposed to the cooling air in the container system unit.”.

Third Schedule—item 4.

5. Item 4 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a)by omitting paragraph 7 (in the second column) and inserting in its stead the following paragraph—

“7. Lemons shall not be described as ‘Standard’ unless—

(a)the skin of the lemons is of good texture and the rind of not more than medium thickness;

(b)the lemons have practically no long necks or other malformations and practically no marked corrugation or ridging; and

(c) if a lemon is blemished—

(i) the blemishes are only superficial;

(ii) the area affected is not unsightly;

(iii) the soundness of the fruit is not affected; and

(iv) the total area affected on a lemon does not exceed ten per centum of the surface of the lemon.”; and

(b)by adding after paragraph 8 (in the second column) the following paragraph—

“9.—(1.) Lemons packed in a fibreboard carton shall, when stowed in a vessel otherwise than in a container system unit, be stowed in such a manner that at least one end or one long face of each carton is freely exposed to the cooling air.

“(2.) Lemons packed in a fibreboard carton shall, when stowed in a container system unit in a vessel, be stowed in such a manner that at least one end of each carton is freely exposed to the cooling air in the container system unit.”.

Third Scheduleitem 5.

6. Item 5 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by adding after paragraph 7 {in the second column) the following paragraph—

“8.—(1.) Mandarins packed in a fibreboard carton shall, when stowed in a vessel otherwise than in a container system unit, be stewed in such a manner that the two ends or at least one long face of each carton is freely exposed to the cooling air.

“(2.) Mandarins packed in a fibreboard carton shall, when stowed in a container system unit in a vessel, be stowed in such manner that the two ends or at least one long face of each carton is freely exposed to the cooling air in the container system unit.”.

Third Schedule— item 6.

7. Item 6 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting from paragraph 3 (in the second column) the word “sound,” and inserting in its stead the words “sound and”;

(b) by omitting from clause (a) of paragraph 9 (in the second column) the word “and”; and

(c) by inserting after paragraph 10 (in the second column) the following paragraph—

“10a.—(1.) Oranges packed in a fibreboard carton shall, when stowed in a vessel otherwise than in a container system unit, be stowed in such a manner that at least one end or one long face of each carton is freely exposed to the cooling air.

“(2.) Oranges packed in a fibreboard carton shall, when stowed in a container system unit in a vessel, be stowed in such manner that at least one end of each carton is freely exposed to the cooling air in the container system unit.”.

Third Schedule— item 8.

8. Item 8 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended—

(a) by omitting from the table in sub-paragraph (2.) of paragraph 1 (in the second column) the words—

“Williams Bon Chretien..........................................

W.B.C.”

and inserting in their stead the words—

“Williams Bon Chretien (or Bartlett).............................

W.B.C.”;

(b) by adding at the end of clause (a) of paragraph 5 (in the second column) the word “and”;

(c) by inserting in sub-paragraph (2.) of paragraph 7 (in the second column), after the words “Williams Bon Chretien”, “(or Bartlett)”;

(d)by omitting paragraph 11a. (in the second column) and inserting in its stead the following paragraph—

“11a. Pears shall not be shipped if their core temperature at the time of loading into a vessel exceeds 40 degrees Fahrenheit.”; and

(e)by omitting clause (c) of sub-paragraph (1.) of paragraph 11 (in the second column) and inserting in its stead the following clause:—

“(c) if they are to be packed in a fibreboard carton or in a polythene bag in a box—be cooled before being so packed; and”.

Third Schedule— item 10.

9. Item 10 in the Third Schedule to the Exports (Fresh Fruit) Regulations is amended by omitting paragraph 4 (in the second column) and inserting in its stead the following paragraph—

“4.—(1.) Plums intended for export shall be shipped in refrigerated space.

“(2.) Plums intended for export to the United Kingdom, the Republic of Ireland, the continent of Europe, the United States of America or Canada packed in a fibreboard carton shall, when stowed in a vessel otherwise than in a container system unit, be stowed in such manner that the two ends or at least one long face of each carton is freely exposed to the cooling air.

“(3.) Plums intended for export to the United Kingdom, the Republic of Ireland, the continent of Europe, the United States of America or Canada packed in a fibreboard carton shall, when stowed in a container system unit in a vessel, be stowed in such manner that at least one end of each carton is freely exposed to the cooling air in the container system unit.”.
